This City Council meeting of the City of Greensboro was called to order at 5:30 P.M. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building.

Mayor Pro-Tem Abuzuaiter confirmed all Councilmembers were in attendance; and recognized Mayor Vaughan, that would participate via Zoom.

Note: Chief Deputy City Attorney Tony Baker attended the meeting on behalf of the City Attorney's Office.

The meeting opened with a moment of silence.

Mayor Pro-Tem Abuzuaiter recognized Councilmember Wells to lead the Pledge of Allegiance to the Flag; and called on City Manager Trey Davis to recognize the courier.

City Manager Davis introduced Zarrie Lewis; highlighted Ms. Lewis' attendance at James Benson Dudley High School; academic successes; current and upcoming collegiate aspirations; and referenced her participation in the Morningside Academy's Human Rights Department.

Mayor Pro-Tem Abuzuaiter explained the Council procedure for conduct of the meeting.

PUBLIC HEARING

  

Mayor Pro-Tem Abuzuaiter stated the applicant for Items H.6./2025-189 and H.7./2025-190 had requested the items to be removed from the agenda.

Moved by Councilmember Thurm, seconded by Councilmember Holston to remove items H.6. and H.7. from the agenda.  The motion carried by voice vote.

GENERAL BUSINESS AGENDA

  

Taking the prerogative of the Chair, Mayor Pro-Tem moved item I.1./2025-199 before the consent agenda.

Library Director Bridgett Blanton recognized Deno Adkins, Senior Vice President of Ambulatory and Consumer Services; and provided an update on the project financing.

Mr. Adkins voiced appreciation for the partnership.

Council commended Cone Health on the support.

  • 048-25 RESOLUTION CALLING A PUBLIC HEARING FOR APRIL 15, 2025 ON THE ANNEXATION OF TERRITORY TO THE CORPORATE LIMITS –PROPERTY LOCATED AT 1872 ANDREWS FARM ROAD – 12.512 ACRES

    WHEREAS, the owner of all the hereinafter-described property, which is noncontiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Chapter 160A, Section 58.2 (noncontiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city; 

    WHEREAS, at a regular meeting of the City Council on the 15th day of April, 2025, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 1872 ANDREWS FARM ROAD – 12.512 ACRES)

    Section 1.  Pursuant to G.S. 160A-58.2 (noncontiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    BEGINNING at a #4 rebar found at the southeast corner of Property of Duke Energy Carolinas, LLC, as recorded in Deed Book 8858, Page 1365, said rebar being at the intersection of the western right-of-way line of Andrews Farm Road (NCSR #3074) and the northern right-of-way line of McConnell Road (NCSR #3000) and having NC Grid Coordinates NAD83(2011) of N:833,674.67, E:1,813,679.74; thence with the northern right-of-way line of McConnell Road the following four (4) courses and distances: 1) with a curve to the left having a radius of 1,639.40 feet and a chord bearing and distance of S 76°14'57" W 70.00 feet to a point, 2) with a curve to the left having a radius of 1,639.40 feet and a chord bearing and distance of S 67°07'09" W 451.02 feet to a #5 rebar, 3) S 57°04'26" W 325.45 feet to a 12’ spike with cap set, and 4) S 57°52'09" W 59.18 feet to a ¾” iron pipe at the southwest corner of said LLC property; thence with the eastern line of John T. Goodman, as recorded in Deed Book 8548, Page 2641, the following three (3) courses and distances: 1) N 01°01'02" E 289.32 feet to #4 rebar, 2) N 63°52'45" W 22.57 feet to a stone, and 3) N 01°36'46" E 69.31 feet to the southeast corner of Sandra W. Doughty, as recorded in Deed Book 2951, Page 183; thence with Doughty’s eastern line N 01°36'46" E 346.72 feet to a divet in stone at the southeast corner of Needham Farm, LLC, as recorded in Deed Book 6959, Page 834; thence with the eastern line of said LLC N 01°34'31" E 290.98 feet to a #4 rebar at the southwest corner of SA Associates Limited Partnership, as recorded in Deed Book 8808, Page 1021; thence with the southern line of said Partnership S 88°31'17" E 768.94 feet to a #4 rebar in the western right-of-way line of Andrews Farm Road; thence with said western right-of-way line S  01°31'43" W 548.11 feet to the point and place of BEGINNING,  containing approximately 12.512 acres.  All deeds referred to hereinabove are recorded in the Office of the Register of Deeds of Guilford County.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.  The above-described territory shall also be subject to all municipal taxes according to the provisions of G.S 160A-58.10.

    Section 6.  That this ordinance shall become effective upon adoption.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That Tuesday, April 15, 2025 at 5:30 p.m. be fixed as the time and the Council Chambers in the Melvin Municipal Office Building as the place for the public hearing on the proposed annexation of territory to the City of Greensboro as above set out and that this resolution be published in a newspaper published in the City of Greensboro not later than April 5, 2025.

    WHEREAS, Chapter 160A, Section 58.2 (noncontiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city;

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 1606 YOUNGS MILL ROAD – 0.9 ACRES)

    Section 1.  Pursuant to G.S. 160A-58.2 (noncontiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    BEGINNING at a point in the western right-of-way line of Young’s Mill Road , said point being the easternmost corner of Lot 13 of Young’s Mill Road Subdivision, as recorded at Plat Book 22, Page 24; thence with the southeastern line of said Lot S 30° 25’ W 400 feet to its southernmost corner; thence with the southwestern line of said Lot N 50° 28’ W 100 feet to the westernmost corner of said Lot; thence with the northwestern line of said Lot N 30° 25’ E 400 feet to the northernmost corner of said Lot, a point in the western right-of-way line of Young’s Mill Road; thence with said right-of-way line S 50° 28’ E 100 feet to the point and place of BEGINNING, being all of said Lot 13 and containing approximately 1.0 acres.  The plat referred to hereinabove is recorded in the Office of the Register of Deeds of Guilford County.

    WHEREAS, the owner of all the hereinafter-described property, which is noncontiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Chapter 160A, Section 58.2 (noncontiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city;

    WHEREAS, at a regular meeting of the City Council on the 15th day of April, 2025, the following ordinance will be introduced; and

    BEGINNING at a #5 rebar set having N.C. NAD 83(2011) grid coordinates of N=827573.53 and E=1742166.57, said #5 rebar being located along the northern right-of-way of York House Drive (formerly Shute House Drive), N 20° 27’ 23” E 94.97 feet from a NCDOT Right-of-Way Monument found along the right-of-way of York House Drive; thence N 30° 02’ 27” W 146.21 feet to a #5 rebar set; thence N 20° 14’ 19” E 25.81 feet to 1 inch pipe; thence S 80° 39’ 27” E 71.06 feet to a 1 inch pipe; thence S 80° 50’ 13” E 49.04 feet to a 1 inch pipe; thence S 02° 25’ 07” W 122.16 feet to an ½ inch rebar; thence a curve turning to the left, having a radius of 75.0000 feet and having a chord with a bearing of S 79° 10’ 15” W and a chord distance of 50.00 feet, an arc distance of 50.98 feet along said curve to the point and place of BEGINNING.  Being approximately 0.289 acres (12,590 square feet) as shown on survey by GEL Solutions dated January 8, 2020.  Said lot also being Lot 63 of King’s Pond at Sedgefield Phase IIID, as recorded in Plat Book 93, Page 138 at the Guilford County Register of Deeds Office.

    WHEREAS, the owner of all the hereinafter-described property, which is contiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Pursuant to G.S. 160A-31 (contiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city; 

    WHEREAS, at a regular meeting of the City Council on the 15th day of April, 2025, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTIES LOCATED AT 4334, 4340 AND 4342 BLACKBERRY ROAD – 11.0 ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    BEGINNING at a point on the existing Greensboro city limit line (as of January 31, 2025), said point being an existing iron pipe at the northwest corner of Lot 1, Phase II of Love & Faith Christian Fellowship, as recorded in Plat Book 172, Page 44, said point being in the eastern right-of-way line of Blackberry Road (NCSR #1111); THENCE PROCEEEDING WITH THE EXISTING CITY LIMITS N 85° 44’ 30” W 30.16 feet to a mag nail in the centerline of said road; thence N 85° 54’ 10” W 30.80 feet to a new iron pipe at the northeast corner of Lot 2, Phase I of Love & Faith Christian Fellowship, as recorded in Plat Book 172, Page 43, said point being in the western right-of-way line of said road; thence with the northern line of said Lot 2 N 85° 51’ 56” W 259.64 feet to an axle; thence continuing with said line N 85° 45’ 41” W 477.80 feet to a nail in stone at the northwest corner of said Lot 2, also being the southwest corner of a third property of Love & Faith Christian Fellowship, as recorded in Deed Book 7024, Page 2006; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with the western line of said third property N 00° 01’ 47” E 539.43 feet to a new iron pipe at the southwest corner of Diane C.     Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    WHEREAS, a portion of said properties is required by the City in connection with the Camp Burton Gravity Outfall Project;

    WHEREAS, negotiations with the owner at the appraised value of $9,550.00 have been unsuccessful and said portions of the properties are necessary for said project;

    WHEREAS, it is deemed necessary and in the best interest of the City that the City Attorney be authorized to institute civil proceedings to condemn said portions of the properties and that the Director of Finance be authorized to issue a draft to the Guilford County Clerk of Court as compensation to the owner(s) in the amount of $9,550.00; and

  • 055-25 RESOLUTION AUTHORIZING THE SALE OF PROPERTY OWNED BY THE REDEVELOPMENT COMMISSION OF GREENSBORO AT 407 GILLESPIE STREET TO TRINITY CONSTRUCTION AND DEVELOPMENT, LLC

    WHEREAS, the Redevelopment Commission of Greensboro owns property at 407 Gillespie Street, acquired as part of the Eastside Park Redevelopment Area;

    WHEREAS, the Greensboro City Council adopted the Eastside Park Redevelopment Plan in February 1993, with amendments made in March 2004 and October 2005;

    WHEREAS, the Redevelopment Commission of Greensboro approved of the sale of the property and signed the necessary sales/development agreement at their meeting on December 4, 2024;  

    WHEREAS, the plan developed for the property is in keeping with the specifications of the updated Redevelopment Plan;

    WHEREAS, the property was advertised for an upset bid in accordance with North Carolina Redevelopment Law;

    WHEREAS, the proceeds from this property conveyance will be credited to the appropriate account; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    WHEREAS, in 2022, the Office of Community Safety for the City of Greensboro recognized the need for a Community Safety Plan;

    WHEREAS, since 2022, Greensboro partnered with Cities United, a national organization focused on helping cities develop effective public safety plans. Through their Roadmap Academy, the Community Safety Department has been working to gather feedback from

    community members and various stakeholders to co-create a Community Safety Plan

    that truly reflects the needs and hopes of our residents;

    WHEREAS, addressing violence prevention through a public health model is vital for creating sustainable and effective strategies within a community safety plan. This approach emphasizes a comprehensive understanding of violence as a public health issue, enabling implementation of targeted interventions that can significantly reduce incidents of violence;

    WHEREAS, the newly created City of Greensboro Community Safety Department Community Safety Plan embodies this approach;

    WHEREAS, the Greensboro City Council is in support of this Plan; and

    WHEREAS, the City of Greensboro is generally authorized to accept donations or money, real and personal property or real estate for the benefit of its citizens;

    WHEREAS, the Greensboro Police Foundation is a non-profit entity that works to support the needs of the Greensboro Police Department when funding falls short;

    WHEREAS, the Greensboro Police Foundation wishes to donate an unmanned aerial vehicle valued at approximately $25,000 to support the department’s operations and mission;

    WHEREAS, the donated unmanned aerial vehicle is an equipment expense outside of the police department’s general fund budget;

    WHEREAS, the Greensboro Police Foundation is funding the equipment and year 1 of the manufacturer’s subscription cost; the police department will fund years 2-5 of the subscription;

    WHEREAS, the staff of the Greensboro Police Department supports the donation;

    WHEREAS, The City Council finds that it is appropriate to accept the donation offered; and

    WHEREAS, on December 17, 2024, the Procurement Services Division conducted an open solicitation through the Greensboro E-Procurement System for an interior cabling services contract;

    WHEREAS, the total estimated contract value of $300,000.00 requires Council’s approval;

    WHEREAS, Guilford Metro 911 serves as the regional radio equipment service provider for various governmental agencies in the Guilford County Region;

    WHEREAS, Guilford Metro 911 and the agency intends to enter into an agreement that establish the fees for the agency to pay for Guilford Metro 911’s services;

    WHEREAS, Guilford County Schools require radio services;

    WHEREAS, services are charged by Guilford Metro 911 to these entities on a piece rate basis established in this interlocal government agreement;

    WHEREAS, service costs for maintenance are to be billed to Guilford County Schools;

    WHEREAS, in accordance with North Carolina law, in order for the City to enter into an interlocal government agreement, City Council approval is required; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

  • 069-25 RESOLUTION APPROVING INTERLOCAL AGREEMENT BETWEEN THE CITY OF GREENSBORO AND GUILFORD COUNTY AND THE CITY OF HIGH POINT FOR A COMMUNITY NOTIFICATION SYSTEM

    WHEREAS, the City of Greensboro, Guilford County, and the City of High Point have collaborated in a joint community notification system since 2010 to benefit the residentsand visitors to these Cities and County and have determined that there are mutual interests and advantages for the parties to maintain this relationship;

    WHEREAS, the City of Greensboro, Guilford County, and the City of High Point reaffirm their commitment to a shared funding Agreement through promulgation of this new amendment to an existing Interlocal Agreement;

    WHEREAS, all parties involved desire to ensure that an Emergency Notification System remains in a high state of readiness and on current technology platforms;

    WHEREAS, the cost to the City for this service will be $40,851.30 annually for the duration of the Agreement;

    WHEREAS, City Council is requested to approve the Interlocal Agreement between the City of Greensboro, Guilford County, and the City of High Point for the Community Notification System presented here today; and

    NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    WHEREAS, The Greensboro Civil Service Board (CSB) is established and authorized with certain powers pursuant to the provisions of Senate Bill 9, Session Law 2023-112 of the 2023 Session Laws of the North Carolina General Assembly, known and hereinafter referred to as the “Greensboro Civil Service Law", and codified in Section 7.45 of the Greensboro City Charter and Related Laws of the City of Greensboro;

    WHEREAS, The CSB is authorized by the Civil Service Law to conduct a hearing, in the event of a timely request from a member of the classified service, as defined in the Civil Service Law, when that member is discharged, suspended, reduced in rank, transferred against his or her will or is denied any promotion or raise in pay to which he or she would be entitled;

    WHEREAS, The CSB has other powers and duties as prescribed by the Civil Service Law;

    WHEREAS, The Rules of Procedure were adopted by the CSB on March 5, 2025;

    WHEREAS, Greensboro City Council in accordance with the Civil Service Law and shall approve the governing proceedings held before the Board; and

  • 071-25 RESOLUTION SUPPORTING THE RECLASSIFICATION OF GUILFORD METRO 911 DISPATCHERS

    WHEREAS, in February of 2025, U.S. Representatives Norma J. Torres and Brian Fitzpatrick along with Senators Amy Klobuchar and Marsha Blackburn announced that they have reintroduced the 9-1-1 SAVES Act in the United States Congress.  The 9-1-1 SAVES Act is bipartisan legislation to reclassify 911 dispatchers from “Office and Administrative Support” to “Protective Service Occupations” in the Office of Management and Budget’s Standard Occupational Classification (SOC) catalog;

    WHEREAS, 911 dispatchers are the first line of response during an emergency, and they deserve to be classified in a way that recognizes their work is on par with the work of other public servants classified as first responders;

    WHEREAS, 911 dispatchers worked with elected officials to re-introduce this legislation this legislative term with the current Congress, and local support will assist this effort;

    WHEREAS, the Greensboro City Council is in support of such a legislative change; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the Greensboro City Council is in support of bipartisan legislation to reclassify 911 dispatchers from “Office and Administrative Support” to “Protective Service Occupations” in the Office of Management and Budget’s Standard Occupational Classification (SOC) catalog.

Mayor Pro-Tem Abuzuaiter stated this was the time and place set for a public hearing to consider items H.1./2025-178 a Public Hearing for an ordinance annexing territory into the corporate limits for the properties located at 5136 Carlson Dairy Rd and 4305-4307 Hamburg Mill Rd - 78.512 Acres (Tom Terrell for Christopher Farms LLC and others); and H.2./2025-179 a Public Hearing for an ordinance for original zoning for 5136 Carlson Dairy Road and 4305-4307 Hamburg Mill Road - Tom Terrell for Multiple LLC's.

Planning Manager Mike Kirkman made a PowerPoint Presentation (PPP); reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; and stated that the Planning and Zoning Commission and staff had recommended approval of the request. 

Speakers in Favor of the Rezoning:

Tom Terrell representing the applicant recognized David Couch and Town Planner Victor Dover.

Mr. Dover; made a PPP; spoke to the Christopher Village location; provided images; highlighted preservation of open space and views; site plans; reviewed proposed street views; a traffic impact study; a protected watershed; explained requirement compliances; highlighted trails and greenways; a walkable and connected neighborhood; a mixed use proposal; housing variety; a garden style apartment building and accessory dwelling units; multi-style missing middle housing; compliance with the Greensboro Comprehensive plan; the Road to 10,000 addition; outlined a village summary; and spoke to quality of life. 

Kevin Kenjarski of Summerfield expressed support for the Christopher Village proposal; spoke to a housing supply crisis; to an alignment with the 2040 Comprehensive Plan; explained fostered exclusive housing; spoke to attraction of talent to the region; to urban growth; and urged Council to vote in favor.

Church Brown from Summerfield explained he served on the Citizen Committee; referenced an email sent to Council; spoke to the need for a master long term plan; and to his support of the project.

Tracy Ruffin before spoke to urban trends; to conservation development; and to protection of open space and water.

Speakers in Opposition of the Rezoning:

Ron Collier referenced his residence in location to the proposed project; property rights; a long time residency; highlighted a rural setting; voiced concern with the loss of a rural neighborhood; and expressed encouragement of preservation of the  rural nature of the property.

Richard Ringler explained he worked as a civil engineer; referenced a Guilford Council project; voiced concerns regarding fire and police response times; safety; and spoke to cost savings in the proposed project.

City Manager Davis explained standard and proper response times.

Al Kampran voiced opposition to the project; concern with water and sewer access; and inquired about water study.

Heath Clay explained he served as a Summerfield Councilmember and resident; referenced an email sent to Council; spoke to misrepresentation by applicant; to House Bill 26; and to the General Assembly setting precedence.

Mr. Kirkman made a PowerPoint Presentation (PPP); reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; stated that the Planning and Zoning Commission and staff had recommended approval of the request; and explained the term ex-urban.

    WHEREAS, the Greensboro City Council is being requested to approve the award of contract #2023-006A to Samet Corporation for Windsor Chavis Nocho Community Complex- Nocho Park construction located at 1010 Duke St.;

    WHEREAS, in 2016 residents approved a bond referendum which included funding for the planning of Windsor Chavis Nocho Community Complex;

    WHEREAS, in July 2022 Greensboro residents approved a $50 million bond referendum for the construction of the facility;

    WHEREAS, in August 2022 the Greensboro City Council approved $8,000,000 for American Rescue Plan Act (ARP) enabled funds for the completion of design development, construction document and construction delivery method;

    WHEREAS, on December 20, 2022 City Council approved a contract in the amount for $750,112 for preconstruction services for the Windsor Chavis Nocho Community Complex;

    WHEREAS, on December 19, 2023, the City Council approved the acceptance of $4,384,285.83 matching grant from the federal Outdoor Recreation Legacy Partnership program (“ORLP”);

    WHEREAS, the City provided a match of $4,384,285.83 and this will be utilized for the park improvements;

    WHEREAS, Samet Corporation has worked over the two years in coordination with Vines Architecture and Evoke Studios for final design completion;

    WHEREAS, Samet gave a Guaranteed Maximum Price in the amount of $11,947,078.00 for the Windsor Chavis Nocho Community Complex - Nocho Park construction;

    WHEREAS, goals were set at 16.4% MBE and 6.90% WBE;

    WHEREAS, Samet Corporation achieved 18.23% MBE and 9.88% WBE; 

    WHEREAS, it is recommended that City Council approve the award of this contract to Samet Corporation for the Windsor Chavis Nocho Community Complex - Nocho Park construction located at 1010 Duke St.; and
