This City Council meeting of the City of Greensboro was called to order at 5:30 p.m. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building.

Mayor Vaughan confirmed all Councilmembers in attendance.

Mayor Vaughan recognized Councilmember Hoffmann to lead the Pledge of Allegiance to the Flag.

Mayor Vaughan explained the Council procedure for conduct of the meeting.

PUBLIC HEARING

  

Mayor Pro-Tem Abuzuaiter read the resolution into the record; and presented the resolution to the family of Office Michael Horan and to Greensboro Police Department (GPD) Chief Thompson. 

GPD Chief Thompson spoke to Office Horan's service to the community and the appreciation for the resolution.

    119-25 RESOLUTION TO HONOR THE MEMORY OF THE LATE GREENSBORO POLICE DEPARTMENT,OFFICER MICHAEL “MIKE” HORAN

    WHEREAS, on December 23, 2024 the Greensboro Police Department and the community lost a hero and valued community member with the passing of the late Greensboro Police Department Officer Michael “Mike” Horan;

    WHEREAS, Officer Horan was born on May 4, 1980 in Fitzgerald, Georgia; served as a lifeguard and first aid /cardiopulmonary resuscitation  instructor in Beach Haven, New Jersey, and graduated from Northwest High School in Greensboro, North Carolina in 1998, where he was a member of both the wrestling and the football teams;

    WHEREAS, Officer Horan began his military career with the United States Coast Guard in January 2000; served as a Law Enforcement Officer, Tactical Fast Boat Instructor, a Search and Rescue Operator; and was selected for Maritime Safety and Security Team 91101 in Seattle;  

    WHEREAS, Officer Horan conducted harbor defense operations in New York City and Washington, DC following the September 11 attacks; throughout his tours of duty, Officer Horan was stationed in North Carolina, Virginia, Washington, St. Thomas US Virgin Islands, New York, and New Jersey; and led counter-terror, counter-narcotics, and counter-human trafficking missions;

    WHEREAS, Officer Horan was recognized and highly decorated to include awards such as: three (3) Coast Guard Achievement Medals; five (5) Commandant Letters of Commendation; six (6) Good Conduct Awards; two (2) Reserve Good Conduct awards; three (3) Special Operations awards; a Sea Service Ribbon; an Overseas Service Medal; and was the Coast Guard’s Enlisted Person of the Year in 2015 and 2019;   

    WHEREAS, he joined the City of Greensboro, North Carolina (NC) Greensboro Police Department (GPD) in September 2017; entered the 103rd Police Basic Introductory Course Academy; in February 2018, was sworn in as a City of Greensboro, NC police officer; and became a reservist in the US Coast Guard;

    WHEREAS, during his time with the GPD, Officer Horan served on the Violent Crime Reduction Team, Crimes Against Persons Unit, and in Patrol Districts 2 and 4; was a member of the Special Events Team; and was an instructor for rapid deployment and active shooter training;

    WHEREAS, while on family vacation at Emerald Isle, NC, Officer Horan knowingly and willingly entered a rip tide and swam 60 yards offshore to save a father and son from drowning; for such a brave and selfless act, Officer Horan was awarded the Lifesaving Award from the GPD; and was recognized by the US Coast Guard for his heroism; 

    WHEREAS, Officer Horan was known as a dedicated family man, and will be dearly missed by family, friends, and colleagues; and

    NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    1. That the City Council wishes to express its condolences, and offer its sincere appreciation and gratitude for the many years of service Officer Michael “Mike” Horan offered to Greensboro and to his country.
    2. That a copy of this resolution shall be delivered to the family of the late Greensboro Police Department Officer Michael “Mike” Horan as a symbol of the gratitude of the people of Greensboro for his dedicated service and contributions to the community, state, and nation.

    129-25 RESOLUTION AUTHORIZING THE SALE OF PROPERTY OWNED BY THE REDEVELOPMENT COMMISSION OF GREENSBORO AT 213, 215, 217, AND 219 SOUTH ENGLISH STREET TO JOHNSON CONSTRUCTION MANAGEMENT, INC

    WHEREAS, the Redevelopment Commission of Greensboro owns property at 213, 215, 217, and 219 South English Street, acquired as part of the Willow Oaks Redevelopment Area;

    WHEREAS, the Morningside/Lincoln Grove Redevelopment Plan was adopted by the Greensboro City Council in 2000;

    WHEREAS, the Greensboro City Council adopted the Willow Oaks Redevelopment Plan on September 19, 2017 as an update to the Morningside/Lincoln Grove Redevelopment Plan after a series of community meetings and surveys was conducted in 2017 to gather citizen input for the planning process;

    WHEREAS, the Redevelopment Commission of Greensboro approved of the sale of the property and signed the necessary sales/development agreement at their meeting on December 4, 2024;  

    WHEREAS, the plan developed for the property is in keeping with the specifications of the updated Redevelopment Plan;

    WHEREAS, the property was advertised for an upset bid in accordance with North Carolina Redevelopment Law;

    WHEREAS, the proceeds from this property conveyance will be credited to the appropriate account; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That pursuant to NCGS 160A-269, the sale of 213, 215, 217, and 219 South English Street from the Redevelopment Commission of Greensboro to Johnson Construction Management, Inc. in the amount of $8,000 is hereby approved; and the City Manager is hereby authorized to execute on behalf of the City of Greensboro a proper deed to convey said property.

George Hartzman spoke to lawn care in various locations; to the Council procedures; to Council Matheny recusal from items; and to Council conflict of interests.

Mayor Vaughan asked staff to explain if there was a conflict. 

City Attorney Chuck Watts explained that Downtown Greensboro Incorporated (DGI) has a fixed contract; and would not benefit from improvements downtown.

Councilmember Hightower spoke to the vendor were a Minority/Women Business Enterprise (MWBE); and this should not be a focus on Downtown Greensboro Incorporated (DGI).

    130-25 RESOLUTION AUTHORIZING THE AWARD OF CONTRACT 11017 TO WALLIS LEIGH MCBRIDE DBA MCBRIDE LAWN CARE, ESTIMATED IN THE AMOUNT OF $810,000.00 FOR MOWING, MAINTENANCE AND LOT CLEAN UP SERVICES FOR THE CITY OF GREENSBORO PLANNING AND ENGINEERING & INSPECTIONS DEPARTMENT

    WHEREAS, on March 14, 2025, the Procurement Services Division conducted an open solicitation through the Greensboro E-Procurement System for a mowing, maintenance, and lot clean-up services contract;

    WHEREAS, the contract has an estimated three-year value of $810,000.00;

    WHEREAS, the total estimated contract value of $810,000.00 requires Council’s approval;

    WHEREAS, the City of Greensboro can better meet the needs and safety of the community by utilizing mowing, maintenance, and lot clean-up services; 

    WHEREAS, this contract is anticipated to run through June 30, 2028;

    WHEREAS, Wallis Leigh McBride DBA McBride Lawn Care was selected as a qualified vendor, and the M/WBE office was involved in the process; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into this contract with Wallis Leigh McBride DBA McBride Lawn Care for mowing, maintenance, and lot clean-up services.

Discussion took place regarding fund appropriations. 

Motion to adopt the budget adjustments requiring Council approval 4/29/2025-5/12/2025 over the amount of $50,000 was approved.

    WHEREAS, there exists annexed areas of the City of Greensboro that are not currently within the City’s standard of emergency response;

    WHEREAS, there exists areas of the City of Greensboro require additional resources to supplement emergency response; 

    WHEREAS, the City of Greensboro desires to enter into a professional services contract with the Pincroft-Sedgefield Fire District., to provide supplemental fire protection for the residents of Greensboro for $1,800,000.00 over the next three fiscal years beginning 7/01/2025; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the Mayor and/or City Manager and the City Clerk are hereby authorized to execute on behalf of the City of Greensboro a contract with Pinecroft-Sedgefield Fire District in the amount of $1,800,000.00 to be made from Account No. 101.40.4004001.5429 over the next three fiscal years.

    122-25 RESOLUTION APPROVING COOPERATIVE AGREEMENT FROM NORTH CAROLINA EMERGENCY MANAGMENT IN THE AMOUNT OF $345,000 TO GREENSBORO FIRE DEPARTMENT FOR HAZARDOUS MATERIALS REGIONAL RESPONSE TEAM

    WHEREAS, the Greensboro Fire Department was selected as one of seven NC regional response teams;

    WHEREAS, the Greensboro Fire Department from NC Emergency Management to maintain this program from 07/01/2025-06/30/2029; and

    NOW, THERFORE, BE IT RESOLVED BY CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the Mayor and/ or City Manager and the City Clerk are hereby authorized to execute on the behalf of the city of Greensboro a cooperative agreement with NCEM, for $345,000 distributed over five years.

    123-25 RESOLUTION APPROVING CHANGE ORDER WITH SAMET CORPORATION CONTRACT 2022-048A IN THE AMOUNT OF $18,414 FOR FIRE STATION 14

    WHEREAS, the City has remodeled fire station 14 to better serve and meet the needs of fire protection coverage to the residents;

    WHEREAS, the City has entered a contract with Samet Corporation for design and construction of Fire Station #14;

    WHEREAS, the City requests a change order #2 for additional work that was not funded in the original contract for $18,414;

    WHEREAS, the funding for these additional requests will come from bond specifically generated for Fire Station #14;

    WHEREAS, there is existing project account appropriations in the Fire Station #14 account; and

    NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    The findings above are hereby adopted, the change order #2 is hereby formally approved, and the City Manager and the City Clerk is hereby authorized to execute on behalf of the City of Greensboro a contract to carry this into effect.

    WHEREAS, the City has remodeled fire station 14 to better serve and meet the needs of fire protection coverage to the residents;

    WHEREAS, the City has entered a contract with Samet Corporation for design and construction of Fire Station #14;

    WHEREAS, the City requests a change order #3 for additional work that was not funded in the original contract for $24,220.00;

    125-25 RESOLUTION TO APPROVE A TIMELINE EXTENSION FROM JUNE 30, 2025 TO JUNE 30, 2026 FOR THE NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY (NCDEQ) COMMUNITY WASTE REDUCTION AND RECYCLING (CWRAR) GRANT AWARDED TO SOLID WASTE AND RECYCLING FOR AI GUIDED CAMERAS

    WHEREAS, City Council authorized the acceptance of the North Carolina Department of Environmental Quality grant funds in an amount up to $50,000 with a $10,005 match for an AI Guided Recycling Outreach Program on May 7, 2024;

    WHEREAS, the installation of the AI camera equipment on the recycling trucks was delayed;

    WHEREAS, additional time is necessary to fulfill the scope of the grant program;

    WHEREAS, the NCDEQ has been notified and has accepted the new timeline proposal;

    WHEREAS, the project timeline will now end June 30, 2026; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the resolution authorizing approval of extending the NCDEQ CWRAR grant timeline from June 30, 2025 to June 30, 2026 be approved.

    126-25 RESOLUTION CALLING A PUBLIC HEARING FOR JUNE 17, 2025 ON THE ANNEXATION OF TERRITORY TO THE CORPORATE LIMITS –PROPERTY LOCATED AT 1805 CUDE ROAD – 1.045 ACRES

    WHEREAS, the owner of all the hereinafter-described property, which is noncontiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Pursuant to G.S. 160A-31 (contiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city; 

    WHEREAS, at a regular meeting of the City Council on the 17th day of June, 2025, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 8105 CUDE ROAD – 1.045 ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    127-25 RESOLUTION AMENDING RESOLUTION #091-25 APPROVING WATER AND SEWER CONNECTION TO SERVE A PROPOSED FACILITY TO BE LOCATED at 1 METALS DRIVE, 5818 AND 5820 WEST GATE CITY BOULEVARD

    WHEREAS, the City of Greensboro Policy for Water and Sewer Services Utility Extension Policy for Areas Outside of the City Limits was adopted with amendments by City Council on April 16, 2024;

    WHEREAS, On February 25, 2025, the Planning and Water Resources Department received a request for water and sewer connections for a proposed facility to be located at 1 Metals Drive, 5818, and 5820 West Gate City Boulevard;

    WHEREAS, the site is outside of the City of Greensboro’s Annexation Agreement and in the Town of Jamestown annexation boundary and the agreement states that the municipalities shall cooperate in the provision of water and sewer services for properties on both sides of the annexation agreement line;

    WHEREAS, the December 13, 2011 agreement includes a provision allowing the Town of Jamestown to request, on the developer’s behalf, a connection to the City of Greensboro’s water and or sewer system; 

    WHEREAS, the property is outside the City’s Water Sewer Service Area (WSSA) and the Water and Sewer Services “Outside the Corporate Limits” policy does not administratively allow approval of this type of request without Council approval;

    WHEREAS, the City Council adopted Resolution #091-25 on April 15, 2025 to authorize a water and sewer connection for 1 Metals Drive, 5818 and 5820 West Gate City Boulevard, but the adopted Resolution #091-25 did not specify that a water connection was authorized; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    128-25 RESOLUTION AUTHORIZING CONTRACT 2023-006B IN THE AMOUNT OF $361,000 WITH S&ME, INC. FOR SPECIAL INSPECTIONS AND MATERIALS TESTING FOR WINDSOR CHAVIS NOCHO COMMUITY COMPLEX BUILDING

    WHEREAS, in 2016 residents approved a bond referendum which included funding for the planning of the Windsor Chavis Nocho Community Complex;

    WHEREAS, in July 2022 residents approved a $50 million bond referendum for the construction of the facility;

    WHEREAS, in August 2022 Greensboro City approved $8,000,000 for American Rescue Plan Act enabled funds for the completion of design development, construction document and construction delivery method;

    WHEREAS, City Council approved the contract for the building construction for $48,252,241 at its  February 18, 2025 meeting;

    WHEREAS, City Council approved the contract for the park redevelopment for $11,947,078 at its March 18, 2025 meeting;

    WHEREAS, on March 17, 2025 a request for qualifications (RFQ) was issued by the City of Greensboro for the services which are a part of this contract;

    WHEREAS, pursuant to North Carolina Building code special inspections and material testing are mandated by Chapter 17 of the North Carolina State Code;

    WHEREAS, four proposals were received and reviewed following City processes for Mini-Brooks qualified based selection;

    WHEREAS, based on the qualification based points scale outlined in the RFQ, S&ME was selected;

    WHEREAS, no goals were set on the Mini Brooks project;

    WHEREAS, SM&E intends to subcontract 20% of the project to a MBE firm; and

    NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Council is authorized to execute a contract with S&ME, Inc. for $361,000 special inspections and material testing for the Windsor Chavis Nocho Community Complex.

Mayor Vaughan stated this was the time and place set for a public hearing to consider item H.1./ID 2025-377 Public Heating for an Ordinance for Rezoning for 4401 Rehobeth Church Road.

Planning Manager Luke Carter made a PowerPoint Presentation (PPP); reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; and stated that the Planning and Zoning Commission and staff had recommended approval of the request.

Isaacson Sheridan Partner, Mark Isaacson made a PPP; spoke to zoning conditions; zoning map; provided an illustrative sketch plan; spoke to amenities; to community meetings; addressed traffic concerns; highlighted comprehensive plan; and spoke to affordable housing.  

Discussion took place regarding traffic; and sidewalks. 

Cheryl McIvor and Crystal Black spoke in opposition of the item; spoke to community meetings; to site issues; to traffic concerns; and to sidewalks.

Discussion continued regarding community growth; safety; and transportation bonds.

    WHEREAS, the Local Government Budget and Fiscal Control Act, as amended, provides for grant project budgeting pursuant to G.S. 159-13.2 as an alternative to annual budgeting of grant projects;

    WHEREAS, in order to alleviate the requirements to re-adopt appropriations from fiscal year to fiscal year and to permit the use of continuing appropriations of the FY 25-26 Workforce Innovation and Opportunity Act Grant and to properly account for such usage, it is deemed in the best interest of the City of Greensboro to establish, by ordinance, a special FY 25-26 grant project for the Workforce Innovation and Opportunity Act with revenues and expenditures being specifically defined as is shown below; and

    Section 1. The budget estimate of the City of Greensboro for the fiscal year beginning July 1, 2025 which was this day submitted to the City Council, is hereby ordered filed with the City Clerk where it shall remain for public inspection for at least ten days from this date.

    Section 2. A copy of said budget estimate shall be made available to all news media in the County.

    Section 3.     Section 4. A public hearing shall be held in the City Council Chamber at 5:30 p.m. on June 3, 2025, at which time the City Council will hear from any persons who may wish to be heard on the budget.

Moved by Councilmember Hoffmann, seconded by Mayor Pro-Tem Abuzuaiter to reappoint Jim Galyon to the ABC Board. The motion carried by voice vote. 

Council highlighted events attended and upcoming events.

Councilmember Hoffmann requested staff to provide an update on priority list for red light cameras. 

Councilmember Hightower requested staff to provide training from Griffin and Strong regarding Goal setting.
