This City Council meeting of the City of Greensboro was called to order at 4:31 p.m. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building. 

Mayor Vaughan conducted a roll call to confirm Councilmembers in attendance; and stated that Councilmember Thurm would participate via Zoom.

Moved by Councilmember Abuzuaiter, seconded by Councilmember Hightower, to go into closed session to preserve the attorney-client privilege between the City's attorneys and the City Council regarding David Wray verses the City of Greensboro, 09CVS2437. The motion carried by voice vote.

Council recessed to closed session at 4:32 p.m.

Moved by Councilmember Holston, seconded by Mayor Pro-Tem Johnson, to return to open session. The motion carried by voice vote. Council reconvened into open session at 5:35 p.m. with all members in attendance.

Mayor Vaughan recognized Councilmember Abuzuaiter to lead the Pledge of Allegiance to the Flag.

Mayor Vaughan explained the Council procedure for conduct of the meeting; and taking the prerogative of the Chair, recognized City Manager Taiwo Jaiyeoba and Intergovernmental Relations Manager LaToya Caesar-Crawford.

Ms. Caesar-Crawford made a PowerPoint Presentation (PPP); introduced Holland and Knight federal lobbyists Senior Policy Advisors Lisa Barkovic and Scott Mason.

Ms. Barkovic continued the PPP; provided an overview of representation; highlighted infrastructure investments; agenda planning; leveraging community support; opportunity alignment; and funding sources.

Mr. Mason spoke to his lobbying experience; to associated corporations; and to federal grant proposals.

Councilmember Hightower encouraged cooperation with United States Environmental Protection Agency (EPA) Administrator Michael Regan for $32 million assistance package; spoke to Bingham Park contamination; to remediation; and to environmental justice.

Ms. Caesar-Crawford explained funding opportunities.

Mayor Vaughan expressed appreciation to the federal lobbyists; spoke to economic development; to housing; and to workforce availability.

Mayor Vaughan asked if anyone wished to remove any items from the consent agenda; and reminded Council that any items removed from the consent agenda, other than for a recusal or for the purpose to vote 'No' would be placed on the next business meeting agenda as a business item.

Councilmember Hightower requested items H.1./ID 2023-132, H.2./ID 2023-134, and H.3./ID 2023-135 be removed from the consent agenda for the purpose of voting 'no'.

    036-23 RESOLUTION AUTHORIZING THE PURCHASE OF THE ENTIRE PROPERTY LOCATED AT 9646 WEST MARKET STREET FROM LAURA WENDY DUNNING IN THE AMOUNT OF $330,000 FOR THE COLFAX WATER BOOSTER STATION, PROJECT P06240

    WHEREAS, in connection with The Colfax Water Booster Station Project, the property owned by Laura Wendy Dunning, Parcel #168923 is required by the City for said Project, said property being shown on the attached maps;

    WHEREAS, the required property has been appraised at a value of $285,000 but the property owner has agreed to settle for the price of $330,000, which settlement, in the opinion of the City Council, is a fair and reasonable alternative to condemnation;

    WHEREAS, the owner has agreed to sell said property to the City at the agreed price and it is deemed in the best interest of the City to purchase said property; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into agreement with Laura Wendy Dunning for the aforementioned property in the amount of $330,000.

    037-23 RESOLUTION AUTHORIZING THE SALE OF FORECLOSURE PROPERTY LOCATED AT 723 PRINCESS ROAD TO LOST BOY HOLDINGS, LLC IN THE AMOUNT OF $12,600

    WHEREAS, the City of Greensboro owns a foreclosure property consisting of a residential lot located at 723 Princess Road, Parcel #56500; said property being shown on the attached map, for which the City has no governmental or other public need;

    WHEREAS, Property Management advertised the lot for sale and accepted the highest bid from Lost Boy Holdings, LLC in accordance with Section 4.122 of the Greensboro Charter;

    WHEREAS, the property was appraised by Sheryl B. Johnson, at a value of $14,000, and the final highest bid of $12,600 was accepted, which amount, in the opinion of the City Council is fair and reasonable; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into agreement with Lost Boy Holdings, LLC for the aforementioned foreclosure property in the amount of $12,600.

    038-23 RESOLUTION CALLING A PUBLIC HEARING FOR MARCH 21, 2023 ON THE ANNEXATION OF TERRITORY TO THE CORPORATE LIMITS – PROPERTY LOCATED AT 511 KALLAMDALE ROAD – 5.64-ACRES

    WHEREAS, the owner of all the hereinafter-described property, which is contiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Chapter 160A, Section 31 (contiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city;  

    WHEREAS, at a regular meeting of the City Council on the 21st day of March, 2023, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 511 KALLAMDALE ROAD – 5.64-ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    Beginning at a point in the existing Greensboro corporate limits (as of December 31, 2022), said point being in the northern right-of-way line of Kallamdale Road (NCSR # 3456), said point also being a corner on City of Greensboro Annexation Drawing D-3248; THENCE PROCEEEDING WITH THE EXISTING CITY LIMITS along said right-of-way line N 84° 58' 20" E 460.00 feet to a point; thence in a southerly direction approximately 60 feet (right-of-way width varies) to the northeast corner of Lot 2 of Property of Robert Layton, as recorded in Plat Book 83, Page 41; thence with the eastern line of said Lot 2 S 00° 16' 19" E 494.45 feet to the southeast corner of said Lot 2, also being the southeast corner of Lot 2A of Exempt Plat for: Trinity Housing Development, LLC, as recorded in Plat Book 210, Page 6; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with the southern line of said Lot 2A the following three (3) courses and distances: 1) N 85° 12' 30" W 210.97 feet to a ½” existing iron pipe, 2) N 85° 37' 53" W 25.13 feet to a ½” existing iron pipe, and 3) N 85° 09' 35" W 236.56 feet to a ½” existing iron pipe at the southwest corner of said Lot 2A; thence with the western line of said Lot 2A N 01° 04' 13" W 411.39 feet to an axle at the northwest corner of said Lot 2A; thence in a northerly direction, crossing Kallamdale Road, approximately 67 feet to the  point and place of BEGINNING, containing approximately 5.64 acres, of which 4.837 acres are outside of street right-of-way.     Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after March 21, 2023, the liability for municipal taxes for the 2022-2023 fiscal year shall be prorated on the basis of 3/12 of the total amount of taxes that would be due for the entire fiscal year.  The due date for prorated municipal taxes shall be September 1, 2023.  Municipal ad valorem taxes for the 2023-2024 fiscal year and thereafter shall be due annually on the same basis as any other property within the city limits.

    Section 6.  That this ordinance shall become effective upon adoption.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That Tuesday, March 21, 2023 at 5:30 p.m. be fixed as the time and the Council Chambers in the Melvin Municipal Office Building as the place for the public hearing on the proposed annexation of territory to the City of Greensboro as above set out and that this resolution be published in a newspaper published in the City of Greensboro not later than March 11, 2023.

    Beginning at a point in the existing Greensboro corporate limits (as of December 31, 2022), said point being the northwest corner of Reedy Fork Ranch, 6915 Lowline Drive, Phase 4, Section 1C4 – Phase 4, as recorded in Plat Book 198, Page 79, and said point being in the eastern right-of-way line of U.S. Highway 29N; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with said right-of-way line N 28° 30' E 781.0 feet to the southwest corner of the Property of William G. Rudd, III as Trustee, as recorded in Deed Book 8131, Page 1273, said corner being a point on the existing Greensboro city limit line; THENCE PROCEEDING WITH THE EXISTING CITY LIMITS with the southern line of said Rudd Property S 89° 00' E 2,323.4 feet to an existing iron pipe at Rudd’s southeast corner, said point also being a point in the western line of Lot 33 of 5605 Tier View Trail, The Villages of Reedy Fork, Phase 4, Section 3H, as recorded in Deed Book 199, Page 131; thence with the western line of said Section 3H S 03° 03' 17" W 400.72 feet to an existing iron pipe at the northwest corner of Lot 26 of Section 3H (having N.C.G.S.     AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 3450 AND 3456 MCCONNELL ROAD – 16.67-ACRES)

    BEGINNING at an existing concrete right-of-way monument in the existing Greensboro city limits (as of December 31, 2022), having NAD 83 (2011) coordinates of: N=840,485.46, E=1,789,205.28, said monument being at the intersection of the northern right-of-way line of Business I-85 and I-40 and the western line of Robert D. Starr and Barbara S. Starr as Trustees of the Starr Living Trust, as recorded in Deed Book 7175, Page 2072; THENCE PROCEEDING WITH THE EXISTING CITY LIMITS with said right-of-way line the following three (3) courses and distances: 1) N 69° 22’ 15” W 487.19 feet to a concrete right-of-way monument having NAD 83 (2011) coordinates of: N=840,657.10, E=1,788,749.33, 2) S 75° 27’ 35” W 88.21 feet to an existing ½” iron rod, and 3) S 75° 43’ 59” W 402.06 feet to an existing 1” iron rod at the southeast corner of Lot 1 of Lowe Property, as recorded in Plat Book 171, Page 109; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with the eastern line of said Lot 1 N 03° 01’ 10” E 331.49 feet to a new ½” iron pipe at the southwest corner of that property of Gary L. Linville and wife Mary B.     042-23 RESOLUTION OUTLINING A WRITTEN RESPONSE TO CERTAIN AUDIT FINDINGS RELATING TO THE CITY’S ANNUAL INDEPENDENT AUDIT FOR FY 2021-2022, AS REQUIRED BY THE LOCAL GOVERNMENT COMMISSION

    WHEREAS, the City of Greensboro completed its annual independent audit of the FY 2021-2022 financial statements and received an unmodified audit opinion;

    WHEREAS, City Council is required to take certain actions regarding the audited financial results as required by the Local Government Commission (LGC) in accordance with NC Administrative Code 20 NCAC 03.0508;

    WHEREAS, City Council needs to adopt a resolution identifying a written corrective action plan for any findings reported by the auditor to the Audit Committee on December 12, 2022;

    WHEREAS, City Council adopted a response to two audit-related matters as follows;

    WHEREAS, City Finance staff identified that certain capital assets transferred within the organization in the prior year (FY 2021) were not properly removed from the fund that made the transfer and were double-counted in the City’s financial records;

    WHEREAS, the necessary accounting correction was made by staff during the normal year-end closing process in FY 2022 and a new secondary management review procedure was implemented for future capital asset disposals and additions that are transferred between departments;

    WHEREAS, the auditor recommended that the City strengthen its established monitoring procedures of subrecipients in the City’s Emergency Rental Assistance Program (ERAP);

    WHEREAS, review of certain ERAP case files reverted to the City had not be completed, and an oversight occurred when one case file tested was marked as reviewed without the review taking place, and case files from multiple award years were listed together as reviewed in FY 2022;    

    WHEREAS, City staff are working to close out the ERAP by September 30, 2025 at such time all reverted cases will be reviewed and monitored by the closure of the program, and staff will strengthen its review procedures to prevent oversight to ensure all cases selected for review are completed and followed up by both the subrecipient and City staff to finalize the monitoring process, and the Fiscal Year of award for each case file will be prominently marked to assist segregation of review files for a particular year under audit, as the review of a case may span multiple years;

    WHEREAS, City staff will take all necessary steps for any corrective actions needed for ERAP as a result of the City’s monitoring procedures; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Council adopts a resolution outlining a written response to certain audit findings relating to the City’s annual independent audit for FY 2021-2022, as required by the Local Government Commission.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after February 21, 2023, the liability for municipal taxes for the 2022-2023 fiscal year shall be prorated on the basis of 4/12 of the total amount of taxes that would be due for the entire fiscal year.  The due date for prorated municipal taxes shall be September 1, 2023.  Municipal ad valorem taxes for the 2023-2024 fiscal year and thereafter shall be due annually on the same basis as any other property within the city limits.

    Section 6.  That this ordinance shall become effective upon adoption.

  • Moved by Councilmember Hightower, seconded by Councilmember Holston, to adopt the ordinance and stated that the Greensboro City Council believed that its action to recommend approval of the original zoning and rezoning request for the properties at 3923, 3927, and 3929 Presbyterian Road from County AG (Agricultural) and City R-3  (Residential Single-family – 3) to City CD-HI (Conditional District – Heavy Industrial) to be consistent with the adopted GSO 2040 Comprehensive Plan and considered the action taken to be reasonable and in the public interest for the following reasons: the request is consistent with the Comprehensive Plan’s Future Built Form Map and Future Land Use Map; the proposed City CD-HI zoning district, as conditioned, permits uses which fit the context of surrounding area and limits negative impacts on the adjacent properties; and the request is reasonable due to the size, physical conditions, and other attributes of the area, it will benefit the property owner and surrounding community, and approval is in the public interest.

    Section 4.  Any violations or failure to accept any conditions and use limitations imposed herein shall be subject to the remedies provided in Chapter 30 of the Greensboro Code of Ordinances.

    Section 5.  This ordinance shall be effective on February 21, 2023.

Mayor Vaughan stated this was the time and place set for a public hearing to consider item I. 7./ID 2023-113 a Public Hearing for an Ordinance for Rezoning for 4200 and 4206 United Street – Marc Isaacson on behalf of Christopher Robinson and Michael Nicholson of Star Investments LLC.

Mr. Kirkman made a PPP; reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; and stated that the Planning and Zoning Commission and staff had recommended approval of the request.

Speaking in favor of the rezoning:

Isaacson Sheridan Law Firm Attorney Marc Isaacson made a PPP; presented maps, aerial diagrams and illustrative drawings; provided an historical parcel use overview; highlighted additional conditions; spoke to perpetual land use chain of title restrictions; to landscaping; to neighborhood communications; to potential clientele base; to small business growth; and to GSO 2040 Plan consistency.

Discussion took place regarding the building facade; operating hours; and security features.

Speaking in opposition of the rezoning:

Andrew Shoffner highlighted Lindley Park and Highland Park dialogue to retain neighborhood character; voiced concern regarding the land development ordinance (LDO); provided an overview of the parcel's zoning history; code compliance interactions; spoke to nonconforming traffic light configurations; to online nature of vehicle purchases; and to property values.

Joyce Eury spoke to the Lindley Park Neighborhood Association Executive Committee support of the Highland Park zoning application appeal; to pedestrian and cyclist safety; and to neighborhood impacts.

Bill Eckard highlighted a 2012 zoning process; and spoke to traffic congestion.

Patty Eckard voiced concern regarding quality of life.

Discussion took place regarding a traffic analysis study.

Transportation Director Hanna Cockburn spoke to project size; to a parcel analysis; to an estimated trip generation; to signal progression modifications; to a crash analysis; to an implementation plan; to sidewalk and turn-lane installation; and to a Technical Review Committee (TRC) meeting.

Speaking in favor in rebuttal of the rezoning:

Attorney Isaacson addressed staff cooperation; spoke to changing circumstances; to amended conditions; to binding restrictive covenants; and to restaurant and retail opportunities.

Discussion took place regarding permitted parcel uses. 

Speaking in opposition in rebuttal of the rezoning:

Mr. Shoffner voiced concern regarding parcel restrictions; spoke to the staff report; to neighborhood character; and to infrastructure.

    046-23 RESOLUTION AUTHORIZING $20 MILLION CONTRACT AGREEMENT WITH THE GREENSBORO SCIENCE CENTER OF GREENSBORO, INC. FOR THE EXPANSION OF BATTLEGROUND PARKS DISTRICT PHASE II FOR FACILITY IMPROVEMENTS 

    WHEREAS, July 26, 2022 the City of Greensboro voters approved a Parks and Recreation bond referendum in the amount of $70,000,000 and of that $20,000,000 was allocated for the continued development of the Battleground Parks District); 

    WHEREAS, the City will contribute approximately $7,000,000 to the Greensboro Science Center to be applied to the design of the project, funded from General Obligation Bonds issued in 2022; 

    WHEREAS, The City will contribute approximately $13,000,000, to be applied to the construction of the project, expected to be funded from General Obligation Bonds to be issued in 2025; 

    WHEREAS, the City has an existing lease with the Greensboro Science Center and the new development will be incorporated in the lease revision in the future; 

    WHEREAS, the funding will be directed toward The Gateway Project which is an innovative 10‐year strategic vision;

    WHEREAS, as a condition of the agreement the Greensboro Science Center, and its contractors, will comply with all applicable provisions of  the Minority and Women Business Enterprises ordinance, and the City's Minority and Women Business Enterprise Plan for Construction, Procurement and Professional Services;

    WHEREAS, the City will reimburse the Greensboro Science Center for approved expenses related to The Gateway Project; and 

    NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO: 

    That the City of Greensboro is authorized to entered into a Contract between the City and Greensboro Science Center of Greensboro, Inc. for the expansion of Battleground Parks District Phase II for facility improvements.

HHGG Vice President and Chief Operations Officer (COO) Ruthie Richardson-Robinson spoke to storm recovery efforts; to housing affordability; and to American Rescue Plan (ARP) funding assistance.

Councilmember Hightower clarified the misconceptions regarding her initial 'no' vote; spoke to ARP intention to assist minority nonprofits and minority small businesses; to a $500,000 set aside for minority contractors; to industry barriers; and to inclusive and diverse housing.

Councilmember Wells highlighted a revised mission and vision; spoke to minority contractor obstacles; to funding; to interest rates; and to reconsider the ARP rationale. 

Discussion ensued regarding contractor certifications; business ownership; insurance; equipment; hiring opportunities; and equitable economic investments.

    WHEREAS, Christ United Methodist Church has offered to the City the property at 1417 Glenwood Ave (Lots 8533, 8534, and 8538 consisting of approximately 1.98 acres), formerly known as Glenwood United Methodist Church, in exchange for $30,000 and a commitment to provide 4 available buildable City lots to be donated to Habitat for Humanity of Greater Greensboro, Inc. for affordable housing production; 

    WHEREAS, the facility will serve as a pilot location for developing an innovative hub for providing government and community partner services and resources directly within the community, as the facility is adapted to an office and public use space; 

    WHEREAS, sufficient funds are available for acquisition of the property in the Nussbaum Housing Partnership accounts; and are allocated in American Rescue Plan (ARP) Act accounts for facility upfits, when those costs have been developed; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    049-23 RESOLUTION AUTHORIZING CITY MANAGER TO PURSUE AN AGREEMENT WITH THE GUILFORD COUNTY BOARD OF EDUCATION REGARDING THE TRANSFER AND ACCEPTANCE OF PROPERTY AT 2301 and 2301 2309 TRADE STREET, KNOWN AS HAMPTON ELEMENTARY SCHOOL

    WHEREAS, Guilford County Board of Education, owner of approximately 17.12 acres of property located at 2301 and 2301  2309 Trade Street, also known as the Hampton Elementary School, has offered to transfer ownership of the school and the surrounding land to the City, said property being shown on the attached map;

    WHEREAS, this property will become part of the City’s property for the purposes of future development, within the City’s unfettered discretion, but may include park space, community support facilities, trails, or other public purposes, as may be determined after receiving community input;

    WHEREAS, subject to the terms of the agreement to be reached between the City and the Board of Education, the City believes it will be in the best interests of the public to accept this transfer from Guilford County Board of Education for the approximately 17.12 acres, located at 2301 and 2301 2309 Trade Street; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City of Greensboro, hereby authorizes the City Manager to pursue and enter into an agreement with the Guilford County Board of Education for the transfer and acceptance of the Hampton Elementary School property, located at 2301 and 2301 2309 Trade Street.

Councilmember Holston reiterated the strategic plan framework; highlighted collaborative efforts; spoke to an International Civil Rights Center and Museum (ICRCM) speaker series; and to the Stephen Tanger Performing Arts Center (STPAC) third Broadway season.

Mayor Vaughan spoke to attending STPAC play, The Book of Mormon.

Councilmember Hoffmann spoke to an upcoming District 4 GPD Police Chief Thompson community event at Lindley Park.
