This City Council meeting of the City of Greensboro was called to order at 4:30 p.m. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building.

Mayor Vaughan confirmed all Councilmembers were in attendance; and stated Councilmember Thurm would be absent.

Moved by Councilmember Hoffmann, seconded by Councilmember Holston to recess to closed session for the purpose to preserve the attorney-client privilege between the City's attorneys and the City Council regarding litigation involving the following parties: Estate Joseph Lopez; Matthew Hamiliton; and to discuss matters relating to the location or expansion of industries or other businesses in the Greensboro area, including agreement on a tentative list of economic development incentives that may be offered by the public body in negotiations. The motion carried by voice vote.

Council recessed to closed session at 4:32 P.M.

Moved by Councilmember Holston, seconded by Councilmember Wells to return to open session at 5:30 p.m. The motion carried by voice vote. 

Moved by Mayor Pro-Tem Abuzuaiter, seconded by Councilmember Hoffmann to excuse Councilmember Thurm from the meeting. The motion carried by voice vote.

Mayor Vaughan recognized Councilmember Pinder to lead the Pledge of Allegiance to the Flag.

Mayor Vaughan explained the Council procedure for conduct of the meeting; and stated City Council was requested to postpone H.13./ID 2025-296 Public hearing for an Ordinance for rezoning for 4401 Rehobeth Church Road. 

There were no Ceremonial and/or Presentation items for this meeting.

Mayor Vaughan asked if anyone wished to remove any items from the consent agenda; and reminded Council that any items removed from the consent agenda, other than for a recusal or for the purpose to vote 'No' would be placed on the next business meeting agenda as a business item.

Councilmember Hightower request to remove Item G.17./ID 2025-295 from the consent agenda for the purpose of voting 'no'.

    082-25 RESOLUTION CALLING A PUBLIC HEARING FOR MAY 20, 2025 ON THE ANNEXATION OF TERRITORY TO THE CORPORATE LIMITS –PROPERTIES LOCATED AT 521 KALLAMDALE ROAD, A PORTION OF 3425 RANDLEMAN ROAD AND A PORTION OF KALLAMDALE ROAD RIGHT OF WAY – 7.27 ACRES

    WHEREAS, the owner of all the hereinafter-described property, which is contiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Pursuant to G.S. 160A-31 (contiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city; 

    WHEREAS, at a regular meeting of the City Council on the 20th day of May, 2025, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTIES LOCATED AT 521 KALLAMDALE ROAD, A PORTION OF 3425 RANDLEMAN ROAD AND A PORTION OF KALLAMDALE ROAD RIGHT OF WAY – 7.27 ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    Beginning at a point in the existing Greensboro corporate limits (as of February 28, 2025), said point being an axle at the southeast corner of that annexation approved by City of Greensboro Ordinance #17-040, said axle also being the southeast corner of Lot 1 of Elmsley Trail, LLC, as recorded at Plat Book 203, Page 22; THENCE PROCEEEDING WITH THE EXISTING CITY LIMITS in a southerly direction, crossing Kallamdale Road, approximately 67 feet to an axle at the northwest corner of Lot 2A of Trinity Housing Development, LLC, as recorded at Plat Book 210, Page 6; thence with the western line of said Lot 2A S 01° 02' 09" E 411.34 feet to a ½” iron pipe in the northern right-of-way line of Interstate 85; THENCE DEPARTING FROM THE EXISTING CITY LIMITS along said right-of-way line the following four (4) courses and distances: 1) N 85° 10' 11" W 251.26 feet to a ½” existing iron pipe, 2) S 03° 59' 36" W 61.80 feet to a ½” existing iron pipe, 3) N 87° 15' 18" W 279.43 feet to a concrete monument, and 4) N 82° 32' 00" W 240.81 feet to a concrete monument at or near the eastern right-of-way line of Randleman Road; thence with said eastern right-of-way line N 10° 42' 12" W approximately 90 feet to a point on the existing city limit line; THENCE PROCEEEDING WITH THE EXISTING CITY LIMITS along said eastern right-of-way line N 10° 42' 12" W approximately 140 feet to its intersection with the southern right-of-way line of Kallamdale Road; thence with said southern right-of-way line N 70° 20' 39" E approximately 260 feet to a corner in the existing city limit line; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with said southern right-of-way line N 70° 20' 39" E approximately 150 feet to its intersection with the southwardly projection of the western line of Lot 1 of Elmsley Trail, LLC; thence with said projection N 02° 17' 19" E approximately 60 feet to an existing iron pin at the southwest corner of said Lot 1, a point on the existing city limit line; THENCE PROCEEEDING WITH THE EXISTING CITY LIMITS the following three (3) courses and distances: 1) N 74° 27' 30" E 101.75 feet to a point, 2) N 83° 11' 24" E 102.63 feet to a point, and 3)  N 86° 01' 11" E 251.43 feet to the  point and place of BEGINNING, containing approximately 7.27 acres, of which approximately 6.64 acres lies outside of street right-of-way.

    All plats referred to hereinabove are recorded in the Office of the Register of Deeds of Guilford County.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.  The above-described territory shall also be subject to all municipal taxes according to the provisions of G.S 160A-58.10.

    Section 6.  That this ordinance shall become effective upon adoption.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That Tuesday, May 20, 2025 at 5:30 p.m. be fixed as the time and the Council Chambers in the Melvin Municipal Office Building as the place for the public hearing on the proposed annexation of territory to the City of Greensboro as above set out and that this resolution be published in a newspaper published in the City of Greensboro not later than May 10, 2025.

    northwest corner of Lot 1 of Reese B.     WHEREAS, at a regular meeting of the City Council on the 20th day of May, 2025, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTIES LOCATED AT A PORTION OF 3725 AND 3739 AND ALL OF 3751 MCCONNELL ROAD – 35.68 ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    085-25 RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTIES LOCATED AT 4231, 4235, 4239 ASHLAND DRIVE FROM DENNIS SNEAD, JR. IN THE AMOUNT OF $452,400 TO ALLEVIATE DOWNSTREAM FLOODING ISSUES

    WHEREAS, The Water Resources Department is purchasing property due to repeated flooding issues. The City of Greensboro is purchasing some of these properties located at 4231, 4235, 4239 Ashland Drive from the owner, Dennis Snead, Jr.; said properties being shown on the attached maps;

    WHEREAS, the subject property has been appraised at a value of $411,000. The owner has agreed to sell the properties for $452,400, which settlement, in the opinion of the City Council, is fair and reasonable; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into agreement with Dennis Snead, Jr. for the aforementioned properties in the amount of $452,400.

    086-25 RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY LOCATED AT 4241 ASHLAND DRIVE FROM JASON VINCENT IN THE AMOUNT OF $203,000 TO ALLEVIATE DOWNSTREAM FLOODING ISSUES

    WHEREAS, The Water Resources Department is purchasing property due to repeated flooding issues. The City of Greensboro is purchasing one of these properties located at 4241 Ashland Drive from the owner, Jason Vincent; said property being shown on the attached maps;

    WHEREAS, the subject property has been appraised at a value of $185,000. The owner has agreed to sell the property for $203,000, which settlement, in the opinion of the City Council, is fair and reasonable; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into agreement with Jason Vincent for the aforementioned property in the amount of $203,000.

  • 087-25 RESOLUTION AUTHORIZING COMMERCIAL LEASE AGREEMENT FOR THE HENDERSON BUILDING LOCATED AT 2301 W. MEADOWVIEW ROAD IN AN AMOUNT OF $503,112.00 ANNUALLY FOR A PERIOD OF 10 YEARS

    WHEREAS, the Workforce Development Department serves as the administrative entity for the GuilfordWorks Workforce Development Board (WDB) to provide services under the Workforce Innovation Opportunity Act (WIOA);

    WHEREAS, the GuilfordWorks Workforce Development Board (WDB) has statutory responsibility for oversight of publicly funded workforce delivery systems for all locations in Guilford County us the Workforce Innovation Opportunity Act (WIOA);

    WHEREAS, there are currently two (2) workforce service locations in Greensboro funded by US Department of Labor administered by the City, including two NCWorks Career Centers (both of which currently house the state employment service), and that Sections 121 and 303 of the new Workforce Innovation and Opportunity Act (WIOA) require that state employment service offices be co-located with workforce career centers;

    WHEREAS, the property owner, American Capital Properties, LLC, has agreed to continue to perform regular and emergency maintenance of the building to meet WDB specifications for a career center and office spaces;

    WHEREAS, the term of the lease for 2301 Meadowview Road will commence on July 1, 2025 and shall end at 11:59 p.m. on June 30, 2035;

    WHEREAS, it is estimated that funding for the lease renewal cost is budgeted in the FY 2025-26 Workforce Innovation and Opportunity Act fund accounts and that no General Revenue funds are requested; and

    WHEREAS, under the Rules and Regulations for the Operation of the City of Greensboro, the Collections Division of the Financial and Administrative Services Department is occasionally required to make write off of invoices;

    WHEREAS, Coliseum customer Teen Mania International was issued an invoice in the amount of $28,014.38, with a due date of June 18, 2015, which is still outstanding.  The customer has since filed for bankruptcy protection and the City has exhausted all collection efforts;

    WHEREAS, Coliseum customer Cirque De Soleil American, Inc. was issued an invoice in the amount of $22,156.64, with a due date of June 11, 2020, which is still outstanding.  The customer has since filed for bankruptcy protection and the City has exhausted all collection efforts;

    WHEREAS, Financial and Administrative Services Department recommends invoice write offs totaling $50,171.02 for Coliseum customers who have filed for bankruptcy protection; and

    WHEREAS, the City of Greensboro Policy for Water and Sewer Services Utility Extension Policy for Areas Outside of the City Limits was adopted with amendments by City Council on April 16, 2024;

    WHEREAS, On February 25, 2025, the Planning and Water Resources Department received a request for water and sewer connections for a proposed facility to be located at 1 Metals Drive, 5818, and 5820 West Gate City Boulevard;

    WHEREAS, the site is outside of the City of Greensboro’s Annexation Agreement and in the Town of Jamestown annexation boundary and the agreement states that the municipalities shall cooperate in the provision of water and sewer services for properties on both sides of the annexation agreement line;

    WHEREAS, the December 13, 2011 agreement includes a provision allowing the Town of Jamestown to request, on the developer’s behalf, a connection to the City of Greensboro’s water and or sewer system;

    WHEREAS, the property is outside the City’s Water Sewer Service Area (WSSA) and the Water and Sewer Services “Outside the Corporate Limits” policy does not administratively allow approval of this type of request without Council approval; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    WHEREAS, G.S. 136-11.1 requires that the North Carolina Department of Transportation (“NCDOT”) request a resolution from all municipalities and counties affected by certain planned transportation projects to express their views on the project prior to any action taken by the North Carolina Board of Transportation (“Board”);

    WHEREAS, the Department has proposed committing in excess of $250,000 for the road improvements at the intersection of SR 1001 (N. Church Street) and Old Lake Jeanette Road to provide increased safety and mobility of the traveling public by adding turn lanes and improving the traffic flow;

    WHEREAS, pursuant to G.S. 136-11.1 the City of Greensboro is provided with the opportunity to state its views on the project through this resolution before action of the Board;

    Section 2.  This property will be perpetually bound to the uses authorized and subject to the development standards of the R-3 (Residential Single Family -3) zoning district unless subsequently changed or amended as provided for in Chapter 30 of the Greensboro Code of Ordinances.  Final plans for any development shall be submitted to the Technical Review Committee for approval.

    Section 3.  Any violations or failure to accept any conditions and use limitations imposed herein shall be subject to the remedies provided in Chapter 30 of the Greensboro Code of Ordinances.

    Section 4.  This ordinance shall be effective on April 15, 2025.

Owner of Cinda Corporation, Virgil Cobb spoke to concerns regarding Minority Women and Business Enterprise (MWBE) bidding process; and public record request.

Discussion took place regarding bidding and documentation timeline; communication between MWBE and contractors; public record request; bid documents; processes and procedures; the effects on the mobile home park; good faith efforts; and setting goals. 

Councilmember Wells requested staff to provide the bid documentation. 

Crews Brother, Daniel Lynch spoke to good faith efforts; to MWBE did a review; to the concrete bid; to material pricing; and to cost.

    101-25 RESOLUTION AUTHORIZING PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF GREENSBORO AND MAULDIN & JENKINS, LLC TO PROVIDE INDEPENDENT AUDIT SERVICES FOR FISCAL YEARS 2025 – 2027

    WHEREAS, in accordance with N.C.G.S. 159-34(a), the North Carolina Local Government Commission (LGC) requires that the governing board takes action in approving independent audit contracts for units of local government and that the selected auditors shall report directly to the board;

    WHEREAS, the City of Greensboro has followed a Request for Proposal (RFP) cycle since 1983 to obtain independent audits of the City’s financial statements, awarding 3-year contracts;

    WHEREAS, in February 2025, the City distributed an RFP for audit services;

    WHEREAS, the City advertised the bid opportunity on the City’s electronic procurement portal and also directly contacted eleven (11) North Carolina auditing firms, including four (4) M/WBE firms. Two (2) of those firms, Cherry Bekaert LLP and Mauldin & Jenkins, LLC submitted proposals; 

    WHEREAS, both proposals were considered well-qualified, and the firm Mauldin & Jenkins, LLC was recommended for contract award based on the firm’s fees for service being the better value along with their willingness to attempt to subcontract a portion of the City’s audit to an M/WBE firm for up to 10% of their audit fee;

    WHEREAS, Mauldin & Jenkins’ proposed FY 2024 - 2025 fee is $107,000 and $330,000 over the life of the contract, including base fee and testing of estimated seven (7) grants;

    WHEREAS, firm qualifications and fees, among other audit-related matters were discussed at the April 2, 2025 Audit Committee meeting; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the professional services agreement between the City of Greensboro and Mauldin & Jenkins, LLC in the amount of $107,000 for FY 2024 - 2025, $110,000 for FY 2025 - 2026 and $113,000 for FY 2026 - 2027 for a total contract award of $330,000 for base fee and estimated seven (7) grants is hereby authorized. The Mayor, City Manager, Finance Director and City Clerk are hereby authorized to execute on behalf of the City of Greensboro a proper contract to carry the proposal into effect.

    102-25 RESOLUTION APPROVING USE OF DESIGN BUILD AND SELECTION OF SAMET CORPORATION AS THE DESIGN BUILDER FOR THE SCIENCE CENTER GATEWAY PROJECT PHASE ONE

    WHEREAS, on February 21, 2023, Council approved a resolution to allocate Twenty Million Dollars ($20,000,000) in Parks and Recreation bond funds to the Greensboro Science Center for Phase 1 of its Gateway Project, which includes a rainforest biodome (Expedition Rainforest – The Greensboro Biodome) and a sea creature care, conservation, rescue, rehabilitation and reintroduction center (the ARCC – Aquatic Rehabilitation and Care Complex);

    WHEREAS, on May 31, 2023, the City of Greensboro entered into a contract with the Science Center to obligate these funds so that the Science Center could begin the design and construction;

    WHEREAS, the Science Center chose to use the Design Build method of construction, and pursuant to North Carolina General Statute (“NCGS”) §143-128.1A, it solicited for Design Builders on two separate occasions, and both times, only one firm, Samet Corporation submitted a proposal; 

    WHEREAS, Samet Corporation was selected as the design builder, and the design has been completed;

    WHEREAS, NCGS §143-128.1A requires governmental entities to first “establish in writing the criteria used for determining the circumstances under which the design‑build method is appropriate for a project” and to select the Design Builder;

    WHEREAS, the Greensboro City Council hereby ratifies the Science Center’s application of the facts of the Biodome Project to the criteria identified in NCGS 143-128.1A as stated in the Agenda Memo for this Council Agenda Item, and its decision to pursue the Design Build method of construction as the best method of construction for this project;

    WHEREAS, the Greensboro City Council hereby ratifies the selection of Samet Corporation as the Design Builder; and  

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    The City Council ratifies (1) the criteria used by the Science Center to determine the circumstances for entering into a Design Build Contract as stated in the Council Agenda Item attached to this Resolution; (2) the Science Center’s decision to use the Design Build method of construction for Phase 1 of the Greensboro Science Center Gateway Project; and (3) the Science Center’s selection of Samet Corporation as the Design Builder for this project.

    103-25 RESOLUTION AUTHORIZING THE USE OF THE DESIGN BUILD METHOD OF CONSTRUCTION FOR THE DESIGN AND REPAIR OF THE LEACHATE SECONDARY CONTAINMENT SYSTEM AT THE WHITE STREET LANDFILL

    WHEREAS, in January 2025, the White Street Landfill experienced a critical, weather-related failure in its 30-year-old leachate secondary containment system;

    WHEREAS, the failure was caused by weather-related breaks to the piping;

    WHEREAS, this containment system is a vital component of the Phase III landfill construction, designed to prevent liquid (leachate) buildup on the landfill liner and enable controlled discharge of leachate into the City's sanitary sewer system;

    WHEREAS, City personnel inspected the system and found that the age of the piping, weather extremes, and the hazardous characteristics of the leachate had rendered the existing system irreparable;

    WHEREAS, damage to the secondary containment's concrete flooring was also identified, requiring repairs before the system can be restarted;

    WHEREAS, as a temporary and emergency solution, the City has contracted with a company to have vacuum trucks suck up the Leachate in the White Street Landfill on a daily basis; however, if this schedule is interrupted for a period of time and/or the landfill receives a significant amount of rain, it will put the environment, the surrounding community and City operations at risk and would violate the engineering design requirements approved by the North Carolina Department of Environmental Quality during landfill permitting; 

    WHEREAS, pursuant to North Carolina General Statute (“NCGS”) 143-128.1A, the Greensboro City Council must first “establish in writing the criteria used for determining the circumstances under which the design‑build method is appropriate for a project”;

    WHEREAS, using the criteria established in NCGS §143-128.1A, the Solid Waste and Recycling Department has applied the facts of this project to the criteria outlined in the statute as stated in the Agenda Memo attached to this Resolution;

    WHEREAS, the Greensboro City Council agrees with the Solid Waste and Recycling Department’s analysis and finds as a fact that the Design Build Method is the best method of construction for this project; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That City Council hereby approves (1) the criteria used by the Solid Waste and Recycling Department to determine the circumstances for entering into a Design Build Contract and the application of the facts of this project to that criteria as stated in the Agenda Memo attached to this Resolution and (2) the use of the Design Build Construction Delivery Method for the Design and Repair of the Leachate Secondary Containment System for the White Street Landfill.
