This City Council meeting of the City of Greensboro was called to order at 5:00 p.m. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building.

Moved by Councilmember Abuzuaiter, seconded by Councilmember Hightower, to go into closed session to discuss matters relating to the location or expansion of industries or other businesses in the Greensboro area, including agreement on a tentative list of economic development incentives that may be offered. The motion carried by voice vote.

Council recessed to closed session at 5:01 p.m.

Moved by Councilmember Abuzuaiter, seconded by Councilmember Holston, to return to open session. The motion carried by voice vote. Council reconvened into open session at 5:39 p.m. with all members in attendance, except for Councilmember Matheny.

Moved by Mayor Pro-Tem Johnson, seconded by Councilmember Abuzuaiter, to excuse Councilmember Matheny from the City Council meeting. The motion carried by voice vote.

Mayor Vaughan recognized Councilmember Abuzuaiter to lead the Pledge of Allegiance to the Flag.

Mayor Vaughan explained the Council procedure for conduct of the meeting.

Mayor Vaughan asked if anyone wished to remove any items from the consent agenda; and reminded Council that any items removed from the consent agenda, other than for a recusal or for the purpose to vote 'No' would be placed on the next business meeting agenda as a business item.

Councilmember Hightower voiced concern regarding Minority Women's Business Enterprise (M/WBE) protocols.

Councilmember Zack Matheny left the meeting at 5:44 PM.

    059-23 RESOLUTION APPROVING CONTRACT IN THE AMOUNT OF $596,000 WITH HAZEN AND SAWYER, PC TO PROVIDE PROFESSIONAL SERVICES FOR THE WATER MASTER PLAN 2023 

    WHEREAS, the City performs water distribution and water master planning approximately every 5 years;

    WHEREAS, water master planning is important to for City growth projections, understanding capacity, infrastructure asset integrity, and capital improvement project planning;

    WHEREAS, Hazen and Sawyer, PC will perform a scope of services that supports the hydraulic modeling and master planning process; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to execute on behalf of the City of Greensboro, a Professional Services Contract for $596,000 with Hazen and Sawyer, PC for the Water Master Plan 2023 Project.

    060-23 RESOLUTION AUTHORIZING $375,000 CONTRACT AGREEMENT WITH THE NATURAL SCIENCE CENTER OF GREENSBORO, INC. FOR THE EXPANSION OF BATTLEGROUND PARKS DISTRICT PARKING EXPANSION

    WHEREAS, January 3, 2023 the Greensboro City Council approved an allocation of $28,893,056 of American Rescue Plan funds;

    WHEREAS, the allocation included a $375,000 allocation to support parking expansion at the Battleground Parks District; 

    WHEREAS, the City will contribute approximately $375,000, to be applied to 50% of the 200 parking space expansion construction of the project;  

    WHEREAS, the contribution by the City will be matched by other funds raised by or contributed to the Science Center;

    WHEREAS, the City has an existing lease with the Science Center and the expansion will be incorporated in the lease once completed; 

    WHEREAS, as a condition of the agreement the Science Center, and its contractors, will comply with all applicable provisions of  the Minority and Women Business Enterprises ordinance, and the City's Minority and Women Business Enterprise Plan for Construction, Procurement and Professional Services;

    WHEREAS, the City will reimburse the Science Center for approved expenses related to the parking expansion; and 

    NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO: 
    That the City of Greensboro is authorized to entered into a Contract between the City and Natural Science Center of Greensboro, Inc. for the expansion of Battleground Parks District for parking improvements.

    061-23 RESOLUTION APPROVING A CONTRACT IN THE AMOUNT OF $750,000 WITH TRIAD ROAD MAINTENANCE, INC. FOR THE INSTALLATION OF THERMOPLASTIC PAVEMENT MARKINGS  

    WHEREAS, the Procurement Services Division conducted an open solicitation through the Greensboro e-Procurement System for the Installation of Thermoplastic Pavement Markings Contract;

    WHEREAS, the contract has an estimated three year value of $750,000;

    WHEREAS, the Transportation Department can maintain infrastructure and promote public safety in the application of thermoplastic pavement markings on City of Greensboro streets;  

    WHEREAS, this contract is anticipated to continue through April 30, 2026;

    WHEREAS, Triad Road Maintenance Company, Inc. was selected as the best value and the M/WBE office was involved in the selection process; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into this contract with Triad Road Maintenance Company, Inc. for the Installation of Thermoplastic Pavement Markings.

    062-23 RESOLUTION IN SUPPORT OF CITY OF GREENSBORO FY 24 CONGRESSIONAL EARMARK PROJECT SUBMITTALS

    WHEREAS, on March 3, 2023, the office of Congresswoman Kathy Manning announced the commencement of the FY 24 Congressional Community Project Process through the dissemination of the Community Project Funding Resource Guide;

    WHEREAS, the resource guide provided valuable information for preparing local government community project requests, including an overview of the congressional appropriations process and a listing eligible funding accounts;

    WHEREAS, to assist Representative Manning’s office in the review of funding requests received from throughout the Triad, local government project submittals were due March 13, 2023;

    WHEREAS, city staff evaluated several projects based on the information provided in the resource guide and in consultation with federal lobbying firm Holland and Knight;

    WHEREAS, the City Manager selected five (5) projects for submittal that offered the best opportunities for competitive success in the FY 24 Community Project process;

    WHEREAS, all five projects were submitted to Representative Manning’s office by the process deadline of March 13, 2023:

    WHEREAS, similar applications and two additional projects will be submitted to the offices of Senator Thom Tillis as the Senate prepares a similar Community Project process;

    WHEREAS, a total of seven (7) Community Projects will be submitted to both Representative Manning and Senator Tillis’ offices;

    WHEREAS, the City of Greensboro City Council wishes to express appreciation for Representative Manning’s efforts in securing $4 million for the City of Greensboro during the FY 23 Community Project process; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Council expresses support for the seven submitted Community Project funding projects and the public safety, infrastructure, economic development, and equitable investment goals that these seven projects would advance.

    WHEREAS, the owner of all the hereinafter-described property, which is noncontiguous to the City of Greensboro, has requested in writing that said property be annexed to the City of Greensboro;

    WHEREAS, Chapter 160A, Section 58.1 (noncontiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city;  

    WHEREAS, at a regular meeting of the City Council on the 17th day of April, 2023, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 1208 RANHURST ROAD – .45 ACRES)

    Section 1.  Pursuant to G.S. 160A-58.1 (noncontiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    BEGINNING at an iron stake in the eastern right-of-way line of Ranhurst Road (N.C.S.R. 2898), said stake being at the northwest corner of Lot 24 of Twilla Acres, as recorded in Plat Book 39, Page 22 in the Office of the Register of Deeds of Guilford County; thence with the northern line of said Lot 24 N 62°08'20" E 161.00 feet to an iron stake at the northeast corner of said lot; thence with the eastern line of said lot  S 34°20'20" E 122.00 feet to an iron stake at the southeast corner of said lot; thence S 62°30'30" W 175.73 feet to an iron stake at the southwest corner of said lot; thence with the eastern right-of-way line of Ranhurst Road N 27°25'20" W 120.00 feet to the point and place of BEGINNING, being all of Lot 24 on said plat and containing approximately 0.45 acres.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after April 17, 2023, the liability for municipal taxes for the 2022-2023 fiscal year shall be prorated on the basis of 2/12 of the total amount of taxes that would be due for the entire fiscal year.  The due date for prorated municipal taxes shall be September 1, 2023.  Municipal ad valorem taxes for the 2023-2024 fiscal year and thereafter shall be due annually on the same basis as any other property within the city limits.

    Section 6.  That this ordinance shall become effective upon adoption.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That Monday, April 17, 2023 at 5:30 p.m. be fixed as the time and the Council Chambers in the Melvin Municipal Office Building as the place for the public hearing on the proposed annexation of territory to the City of Greensboro as above set out and that this resolution be published in a newspaper published in the City of Greensboro not later than April 7, 2023.

    BEGINNING at the northwest corner of Lot 38 of Section Three of Trailwood Acres, recorded at Plat Book 56, Page 128; thence with the northern line of said Lot 38 S 67 57’ 50” E 278.85 feet to the northeast corner of said Lot 38; thence with the eastern line of said lot S 05 40’ 04” W 165.00 feet to the southeast corner of said lot; thence with the southern line of said lot N 60 31’ 05” W 337.81 feet to the southwest corner of said lot, being a point on the eastern right-of-way line of Trailwood Drive; thence with said right-of-way line N 29 13’ E 23.36 feet to a point; thence with said right-of-way line with a curve to the left having a radius of 880.00 feet and a chord bearing and distance of N 26 14’ E 91.60 feet to the point and place of BEGINNING, being all of said Lot 38 and containing approximately 0.95 acres.  The plat referred to hereinabove is recorded in the Office of the Register of Deeds of Guilford County.

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 5005 HIGH POINT ROAD – 1.528 ACRES)

    BEGINNING at a 1/2” iron pipe set in the southeastern right-of-way line of High Point Road (SR 4121) at the northern corner of Lot 2 of Valley Brook Technical Center, recorded at Plat Book 194, Page 129; thence with the northeastern line of said Lot 2 S 54 22’ 36” E 415.58 feet to a T-bar found at the eastern corner of said Lot 2; thence with the southeastern line of said lot S 37 32’ 01” W 162.11 feet to a ½” iron pipe set at the southern corner of said lot; thence with the southwestern line of said lot N 54 22’ 36” W 406.06 feet to a ½” iron pipe set at the western corner of said lot, being a point on the southeastern right-of-way line of High Point Road; thence with said right-of-way line N 34 10’ 33” E 50.93 feet to #4 rebar found; thence with said right-of-way line N 34 09’ 58” E 111.14 feet to the point and place of BEGINNING, being all of said Lot 2 and containing approximately 1.528 acres.  The plat referred to hereinabove is recorded in the Office of the Register of Deeds of Guilford County.

    WHEREAS, Chapter 160A, Section 31 (contiguous) of the General Statutes of North Carolina provides that territory may be annexed after notice has been given by publication one time in a newspaper of general circulation in the city;  

    WHEREAS, at a regular meeting of the City Council on the 17th day of April, 2023, the following ordinance will be introduced; and

    AN ORDINANCE ANNEXING TERRITORY TO THE CORPORATE LIMITS (PROPERTY LOCATED AT 3450 AND 3456 MCCONNELL ROAD – 16.67-ACRES)

    Section 1.  Pursuant to G.S. 160A-31 (contiguous), the hereinafter-described territory is hereby annexed to City of Greensboro:

    BEGINNING at an existing concrete right-of-way monument in the existing Greensboro city limits (as of December 31, 2022), having NAD 83 (2011) coordinates of: N=840,485.46, E=1,789,205.28, said monument being at the intersection of the northern right-of-way line of Business I-85 and I-40 and the western line of Robert D. Starr and Barbara S. Starr as Trustees of the Starr Living Trust, as recorded in Deed Book 7175, Page 2072; THENCE PROCEEDING WITH THE EXISTING CITY LIMITS with said right-of-way line the following three (3) courses and distances: 1) N 69° 22’ 15” W 487.19 feet to a concrete right-of-way monument having NAD 83 (2011) coordinates of: N=840,657.10, E=1,788,749.33, 2) S 75° 27’ 35” W 88.21 feet to an existing ½” iron rod, and 3) S 75° 43’ 59” W 402.06 feet to an existing 1” iron rod at the southeast corner of Lot 1 of Lowe Property, as recorded in Plat Book 171, Page 109; THENCE DEPARTING FROM THE EXISTING CITY LIMITS with the eastern line of said Lot 1 N 03° 01’ 10” E 331.49 feet to a new ½” iron pipe at the southwest corner of that property of Gary L. Johnson added onto said Lot 1 at Deed Book 7497, Page 1136;

    All plats and deeds referred to hereinabove are recorded in the Office of the Register of Deeds of Guilford County.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after April 17, 2023, the liability for municipal taxes for the 2022-2023 fiscal year shall be prorated on the basis of 4/12 of the total amount of taxes that would be due for the entire fiscal year.  The due date for prorated municipal taxes shall be September 1, 2023.  Municipal ad valorem taxes for the 2023-2024 fiscal year and thereafter shall be due annually on the same basis as any other property within the city limits.

    Section 6.  That this ordinance shall become effective upon adoption.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That Monday, April 17 2023 at 5:30 p.m. be fixed as the time and the Council Chambers in the Melvin Municipal Office Building as the place for the public hearing on the proposed annexation of territory to the City of Greensboro as above set out and that this resolution be published in a newspaper published in the City of Greensboro not later than April 7, 2023.

Mayor Vaughan stated this was the time and place set for a public hearing to consider items H.1./ID 2023-171 a Public Hearing for an Ordinance Annexing Territory into the Corporate Limits for the Property Located at 511 Kallamdale Road and Portion of Kallamdale Road Right of Way – 5.64 Acres (Rural Housing Developers - North Carolina, LLC); H.2./ID 2023-175 a Public Hearing for an Ordinance for Original Zoning for 511 Kallamdale Road – Traci Dusenbury and Halcon Companies on behalf of Ryan and Douglass Hamilton); and H.3./ID 2023-176 a Public Hearing for an Ordinance for Original Zoning for a Portion of Kallamdale Road Right of Way – City of Greensboro).

Planning Manager Mike Kirkman made a PowerPoint Presentation (PPP); reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; and stated that the Planning and Zoning Commission and staff had recommended approval of the request.

Speakers in favor of the rezoning:

Southeast Coalition member Cheryl McIvor spoke to density; referenced a senior living facility; and spoke to fencing.

Councilmember Hightower inquired into a community-use agreement (CUA).

Ms. McIvor addressed guidelines outside zoning conditions; spoke to safety; and to amenities.

East Greensboro Nurturing Opportunities and Wealth (NOW) President Mac Sims spoke to communication; to East Greensboro investment initiatives; and to management efforts.

Halcon Companies, LLC owner Traci Dusenbury Tate spoke to community meetings; to industry standards; addressed senior safety; property maintenance; to a CUA; and provided highlights of housing needs.

Councilmember Holston spoke to the zoning process; to the Southeast Coalition; to diverse District 1 housing; and to collaborations.

    Section 2.  Any utility line assessments, which may have been levied by the County, shall be collected either by voluntary payment or through foreclosure of same by the City.  Following annexation, the property annexed shall receive the same status regarding charges and rates as any other property located inside the corporate limits of the City of Greensboro.

    Section 3.  The owner shall be fully responsible for extending water and sewer service to the property at said owner’s expense.

    Section 4.  From and after the effective date of annexation, the above-described territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force within the City and shall be entitled to the same privileges and benefits thereof, subject to the provisions in Sections 2 and 3 above.

    Section 5.  From and after March 21, 2023, the liability for municipal taxes for the 2022-2023 fiscal year shall be prorated on the basis of 3/12 of the total amount of taxes that would be due for the entire fiscal year.  The due date for prorated municipal taxes shall be September 1, 2023.  Municipal ad valorem taxes for the 2023-2024 fiscal year and thereafter shall be due annually on the same basis as any other property within the city limits.

    Section 6.  That this ordinance shall become effective upon adoption.

Mayor Vaughan stated this was the time and place set for a public hearing to consider items H.6./ID 2023-174 a Public Hearing for an Ordinance Annexing Territory into the Corporate Limits for the Property Located at 9064 West Market Street – 4.07-Acres (Black Cobra Building Supplies, LLC); and H.7./ID 2023-177 a  Public Hearing for an Ordinance for Original Zoning for 9064 West Market Street – James Alex Hale for John Castro of Black Cobra Building Supplies, LLC.

Mr. Kirkman made a PPP; reviewed the request; presented maps, aerial photographs and diagrams to illustrate the site and surrounding property; read the conditions attached to the zoning request; and stated that the Planning and Zoning Commission and staff had recommended approval of the request.

    WHEREAS, American Rescue Plan Act funding in the amount of $59.4 million was awarded to Greensboro with the first allocation of $29.7 million received by the City on May 19, 2021 and the remaining allocation of $29.7 million received by the City on June 21, 2022;  

    WHEREAS, the grantor, U.S Treasury, has provided guidance on the use of funds, including for purposes of recovering revenue losses and grant funds can be used for authorized government services under this category;

    WHEREAS, funding from the American Rescue Plan will provide revenues for authorized government activities under the revenue loss category.  This will provide grant availability in other revenues to allow for expenditures of $460,000;

    WHEREAS, Staff will administer the recording of these general government expenses using these funds in accordance with the guidance provided by U.S. Treasury and the use of grant revenues will make available general and other fund revenues to support projects identified through the American Rescue Plan process by City Council; and

    070-23 RESOLUTION TO AUTHORIZE LOW INCOME HOMEOWNER ASSISTANCE PROGRAM

    WHEREAS, City Council desires to assist low income homeowners who have experienced rising costs of homeownership; 

    WHEREAS, a pilot Low Income Homeowner Assistance Program has been developed to provide direct assistance to owner occupants who meet the eligibility requirements; 

    WHEREAS, up to $250,000 is recommended to fund assistance under this pilot phase with maximum assistance per applicant limited to the difference between City taxes paid for tax year 2021 and any subsequent annual tax years beginning with tax year 2022; 

    WHEREAS, eligible homeowners will be able to apply online or through paper applications and outreach will be made through local organizations to reach special populations including elderly, non-English speaking, and low income groups; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That it approves the resolution authorizing up to $250,000 in pilot program assistance to be offered to low income homeowners.

City Manager Taiwo Jaiyeoba spoke to Cone Health healthcare disparities; and to a patrol vehicle update. 

Assistant City Manager Trey Davis provided an overview of the GPD patrol vehicle deployment; equipment installation process; fleet management updates; and security fences. 

Deputy City Manager Chris Wilson provided Greensboro-Randolph Megasite updates; commended the Water Resources Department staff; and spoke to future infrastructure.

Moved by Councilmember Abuzuaiter, seconded by Councilmember Hightower, to appoint Myra Vazquez to the Human Rights Commission, to replace Doug Vender. The motion carried by voice vote. 

Mayor Pro-Tem Johnson commended the city's basketball tournaments and swim championship events; and spoke to the Stephen Tanger Performing Arts Center (STPAC). 

Councilmember Abuzuaiter requested staff to provide a public safety compensation and benefits analysis update; and recognized the Ramadan holiday.

City Manager Taiwo Jaiyeoba spoke to incentive pay; and to pre-budget considerations.

Mayor Vaughan requested staff to provide Greensboro Police Department (GPD) take-home vehicle deployment, security fencing, and satellite office updates.

Councilmember Thurm spoke to a ride-a-long experience; and requested staff to provide GPD patrol vehicle alternatives.

Councilmember Holston highlighted the Carolina Cowboys Professional Bull Riding (PBR) series; and requested staff to provide high-level data tracking updates during City Council meetings.

Councilmember Hoffmann commended Water Resources Department staff; highlighted the Alcoholic Beverage Control (ABC) Board financial contributions; and spoke to private-public collaborations.

Mayor Pro-Tem Johnson left the meeting at 6:52 p.m.; and returned at 6:55 p.m.

Councilmember Wells announced a new Pyramids Village development; spoke to transformative projects; and to revitalization efforts.

Councilmember Hightower requested staff to provide M/WBE pay equity and disparity study updates; to attach the M/WBE goal setting spreadsheets to agenda items; and provided highlights of a future Environmental Protection Agency (EPA) $32 million Bingham Park remediation request. 

Discussion ensued regarding Requests for Proposals (RFPs); outreach efforts; equitable job comparisons; local university resources; and future fiscal analysis.

Mayor Vaughan provided STPAC patron and ticket sale statistics; and announced an upcoming State of the City Address at Piedmont Hall.
