This City Council meeting of the City of Greensboro was called to order at 5:00 p.m. on the above date in the Katie Dorsett Council Chamber of the Melvin Municipal Office Building.

Mayor Vaughan conducted a roll call to confirm Councilmembers in attendance.

Moved by Councilmember Thurm, seconded by Councilmember Abuzuaiter, to go into closed session to discuss matters relating to the location or expansion of industries or other businesses in the area served by the City of Greensboro, including agreement on a tentative list of economic development incentives that may be offered by the City in negotiations that will benefit the City in the areas of travel, tourism, and jobs. The motion carried on the following roll call vote:

Council recessed to closed session at 5:02 p.m.; and reconvened at 5:30 p.m. with all members in attendance.

Moved by Councilmember Thurm, seconded by Councilmember Abuzuaiter, to return to open session. The motion carried by voice vote.

The meeting opened with a moment of silence.

Mayor Vaughan highlighted recent incidents including Robb Elementary School in Uvalde, Texas, and Tops Friendly Market Store in Buffalo, New York.

Mayor Vaughan recognized Councilmember Wells to lead the Pledge of Allegiance to the Flag.

Mayor Vaughan explained the Council procedure for conduct of the meeting; and encouraged safety precautions in light of an increase in local COVID-19 positivity rates.

Councilmember Hoffmann read the resolution into the record; recognized American Association of University Women (AAUW) Greensboro Branch President Laura Tew; highlighted sports achievements; and spoke to Science, Technology, Engineering, and Math (STEM) careers.

Ms. Tew expressed gratitude for the recognition; and spoke to a societal impact.

Mayor Vaughan highlighted the equity of Atlantic Coast Conference (ACC) basketball tournaments; and spoke to the sports community commitment to athletes.

    187-22 RESOLUTION TO RECOGNIZE TITLE IX 50TH ANNIVERSARY ON JUNE 23, 2022

    WHEREAS, Title IX  of the Education Amendments of 1972 has, in the 50 years since its passage, expanded opportunities for women and girls in sports and in the science, technology, engineering, and math (STEM) fields and improved protections for pregnant and parenting students;  

    WHEREAS, Title IX prohibits sex discrimination in all areas of education, protecting students and staff in any educational institution that receives federal funds;  

    WHEREAS, according to American Association of University Women (AAUW) research, 56% of female students and 40% of male students grades 7-12 and two-thirds of college students experience sexual harassment;  

    WHEREAS, girls have 1.2 million fewer chances to play sports in high school than boys and less than two-thirds of Black and Hispanic girls play sports, while more than three-quarters of white girls do;  

    WHEREAS, only 21% of engineering majors and 19% of computer science majors are women, and the rate of women’s enrollment in certain nontraditional careers remains at low levels, with some fields well below 25% in women’s representation;  

    WHEREAS, pregnant and parenting students are often steered toward separate, less rigorous schools;  

    WHEREAS, local schools, colleges, and universities are committed to gender equity and have dedicated resources to that end;

    WHEREAS, the U.S. Department of Education has worked to systematically dismantle Title IX protections in recent years, rescinding multiple important guidance documents in 2017 and  releasing a new rule in 2020 with significant harmful implications for students’ civil rights and  federal enforcement of Title IX;  

    WHEREAS, proposed changes to current Title IX regulations would not be enforced until 2024, leaving students and survivors of sexual harassment and violence without the resources and support they need now;  

    WHEREAS, the U.S. Department of Education announced in 2021 that it would interpret and enforce Title IX to prohibit discrimination based on sexual orientation and on gender identity, an important step to ensure protections for LGBTQ+ students;  

    WHEREAS, we must act now to pass the Gender Equity in Education Act, which would codify protections designed to help students address sex discrimination in all areas of education and ensure educational institutions have the resources needed to comply with Title IX regulations; 

    WHEREAS, Title IX must be strengthened and vigorously enforced to protect students’ civil rights; and 

    NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO: 

    1. That the City Council wishes to recognize the 50th Anniversary of Title IX of the Education Amendments of 1972 on June 23, 2022.

Councilmember Abuzuaiter read the resolution into the record; and recognized Family Justice Center (FJC) Director Catherine Johnson.

Ms. Johnson voiced appreciation; provided an overview of collaborative partnership efforts; community engagement; pandemic challenges; and congratulated Attorney Margaret Dudley's Legal Legend of Color award from the National Bar Association.

Councilmember Hightower spoke to the FJC's efforts to assist a constituent.

Councilmember Abuzuaiter left the meeting at 5:51 p.m.; and returned at 5:55 p.m.

Councilmember Wells and Mayor Pro-Tem Johnson highlighted Attorney Dudley's accomplishments.

Ms. Dudley spoke to Mayor Pro-Tem Johnson's contribution to the National Family Justice Center conference in San Diego, California.

    188-22 RESOLUTION RECOGNIZING THE SEVENTH ANNIVERSARY OF THE FAMILY JUSTICE CENTER (FJC)

    WHEREAS, the Guilford County Family Justice Center (FJC) opened in Greensboro June 15, 2015, with a mission to empower family violence victims to live free from violence and abuse, and hold offenders accountable by providing easily accessible, coordinated, and comprehensive services in a single location;

    WHEREAS, FJC is a “one stop shop” for victims of domestic violence, sexual assault, child abuse, and elder abuse that incorporates more than 100 professionals from 18 different disciplines who work together to provide consolidated and coordinated safety, legal, social, and health services to those in need;

    WHEREAS, through FJC, survivors have access to a wide range of supportive resources such as victim advocacy; filing a restraining order; civil and criminal legal support; law enforcement follow-up; medical care; counseling; and assistance accessing shelter as well as other community resources; 

    WHEREAS, the success of the FJC is rooted in partnerships, and through its work and services there has been significant overall decrease in the number of domestic violence related homicides since the FJC’s inception;  

    WHEREAS, some of the key accomplishments over the past seven years include, but are not limited to, the following: service to over 55,00 individuals and families, opening a second location in High Point, increased access to emergency legal assistance, availability of electronic filing for restraining orders, establishment of a specialized medical clinic for abused children, nationally recognized programming focused on reducing child trauma and elder abuse, and continued in-person operations throughout the COVID-19 pandemic;

    WHEREAS, the City of Greensboro commends FJC for their work; and 

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF GREENSBORO; 

    That it hereby recognizes the Guilford County Family Justice Center on its seventh anniversary and extends appreciation for the contributions FJC has made to the community over the past seven years.

Guilford Metro 911 Director Melanie Jones provided highlights of the National Emergency Number Association and the Association of Public Safety Communications Officials annual conference; and recognized statewide award winners Angela Mitchell, Jeri Phillips, Keith Hayes, and herself.

Mayor's Committee for Persons with Disabilities Chairperson Paige Sprinkle recognized subcommittee members; announced the three $1000 scholarship award winners Joel Holt, Brionna Roberts, and Micah Crump; spoke to community volunteerism; to extracurricular activities; and to future higher educational endeavors.

Mayor Vaughan voiced appreciation to staff's commitment to the Scholarship Committee; and highlighted the Annual Shopper's Day event.

Discussion took place regarding the Joseph Lopez case body worn camera (BWC) footage.

Dr. Anjail Ahmad voiced concern regarding the paratransit service enhancements; spoke to ridership financial impacts; to iRide driver corporate sensitivity training; and invited Council to observe shift operations.

Councilmember Hightower spoke to contract negotiations; and to iRide driver shortages.

Tracy Clark voiced concern regarding the mass shooting incidents; highlighted child safety; and spoke to gun legislation.

Robert Hoke read a statement concerning employment discrimination allegations.

Katie Rossabi spoke in support of the Greensboro Police Department; to public safety staffing impacts; to the Lopez case; and to law enforcement protocols.

The following speakers voiced concern regarding the Lopez case, BWC footage, government transparency, and training standards: Paulette Montgomery, Christine Hoepfner, and Hester Petty. 

Discussion ensued regarding court protocols; an order to disclose; and a BWC video release timeline. 

Koreanne Burt spoke to property inheritance; to improper demolition orders; and to title verification.

Mayor Vaughan requested the City Attorney's Office contact Ms. Burt.

Guilford County teacher Frank Barton provided an overview of the Rankin Elementary "Do You Have a Voice?" program; presented student letters requesting blinking signage; and advocated for traffic safety.

Paul Potts voiced concern regarding employment status following a medical issue. 

City Manager Taiwo Jaiyeoba provided an overview of Mr. Potts case; and Human Resources Department processes.

Mayor Vaughan referred Mr. Potts to follow up with city staff.

Taking the prerogative of the Chair, Mayor Vaughan requested the City Attorney to clarify the judge's order regarding the Lopez case.

City Attorney Watts read the Lopez case BWC footage court order.

Discussion ensued regarding a video compilation; availability to the general public; and video footage placement on the city website.

Mayor Vaughan asked if anyone wished to remove any items from the consent agenda; and reminded Council that any items removed from the consent agenda, other than for a recusal or for the purpose to vote 'No' would be placed on the next business meeting agenda as a business item.

Councilmember Hightower requested removal of item G.2./ID 2022-601.

Mayor Vaughan stated the item would be on the business portion of the June 21, 2022 City Council meeting.

    189-22 RESOLUTION APPROVING CONTRACT FOR REGIONAL HAZARDOUS MATERIALS EMERGENCY RESPONSE TEAM SERVICES FROM NORTH CAROLINA DEPARTMENT OF PUBLIC SAFETY

    WHEREAS, the Greensboro Fire Department wishes to continue to serve as a Hazardous Materials Regional Response Team for a fourteen county area in North Carolina;

    WHEREAS, these authorized responses are fully funded by the State of North Carolina;

    WHEREAS, the Greensboro Fire Department has partnered with the North Carolina Department of Public Safety to provide these responses;

    WHEREAS, the Greensboro Fire Department deems this to be in the best interest of the fourteen county area to accept this responsibility; and

    NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager be authorized to accept funds from the North Carolina Department of Public Safety to continue to host a Hazardous Materials Regional Response Team for the 2020- 2024 contract term.

    190-22 RESOLUTION OF SUPPORT US-29 SERVICE ROAD STUDY

    WHEREAS, G.S. 136-11.1 requires that the North Carolina Department of Transportation ("NCDOT") request a resolution from all municipalities and counties affected by certain planned transportation projects to express their views on the project prior to any action taken by the North Carolina Board of Transportation ("Board");

    WHEREAS, the Department has proposed committing in excess of $250,000 for a service road study on US -29 along the R-5889 STIP project corridor to determine control access, right of way and impacts;

    WHEREAS, pursuant to G.S. 136-11. 1, the City is provided the opportunity to state its views on the study through this resolution before action of the Board;

    WHEREAS, the Department and the Board shall consider, but shall not be bound by, the views of the City regarding the Project; and

    NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City supports the completion of the study because it will enhance the safety of the traveling public in the area and requests the Department and the Board approve the study.

    191-22 RESOLUTION RECOGNIZING AND CELEBRATING JULY AS PARKS AND RECREATION MONTH 

    WHEREAS, the National Recreation and Park Association has celebrated the month of July as National Parks and Recreation Month since 1985; and our own Parks and Recreation Department has served Greensboro since 1933; 

    WHEREAS, during this time, the Parks and Recreation Department has established itself as both an integral, trusted part of the Greensboro community, and as an industry leader in being innovative, collaborative, and efficient towards meeting community needs; 

    WHEREAS, parks and recreational programs and amenities are vitally important to establishing and maintaining the quality of life in Greensboro, ensures the health of all citizens, and contributes to the economic and environmental well-being of the community and region;

    WHEREAS, through the support of the City Council, Parks and Recreation Commission, community partners and dedicated professionals, the Parks and Recreation Department provides progressive leadership, and develops strong partnerships with public and private organizations to literally and figuratively change the landscape of Greensboro; 

    WHEREAS, the Parks and Recreation Department has been recognized nationally for best practice in terms of business operations and programming, and many of their team members are considered subject matter experts in the field, presenting at state and national conferences; 

    WHEREAS, through its adopted 20-year comprehensive master plan, Plan2Play, the Parks and Recreation Department has committed to a vision that will enhance and expand parks, facilities, and programs; and through its services further connect all generations and neighborhoods within Greensboro; 

    WHEREAS, parks and recreational programs and amenities are vitally important to establishing and maintaining the quality of life in Greensboro, ensuring the health of all residents, and contributing to the economic and environmental well-being of the community and region; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    1.    That it recognizes each and every July as Parks and Recreation Month in the City of Greensboro. 

    2.    That it expresses its support for the Greensboro Parks and Recreation Department, its staff, and their vision and role for creating transformational recreation experiences that improve the quality of life and contribute to the economic viability of Greensboro.

    193-22 RESOLUTION TO APPROVE A 7 YEAR CONTRACT RENEWAL IN THE AMOUNT OF $1,110,000 WITH GREENSBORO SPORTS FOUNDATION

    WHEREAS, Greensboro Sports Foundation was formed to provide entertainment, hosting and other general assistance in connection with hosting various events at the Greensboro Coliseum Complex, including basketball tournaments;

    WHEREAS, the contract was last renewed in 2015 and is up for renewal this year;

    WHEREAS, the contract up for renewal is for 7 years in the amount of $1,110,000; and 

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to approve a 7 year contract renewal in the amount of $1,110,000 with Greensboro Sports Foundation.

    194-22 RESOLUTION AUTHORIZING CONTRACT 2022-11005 IN THE AMOUNT OF $268,800 WITH KIMLEY-HORN AND ASSOCIATES, INC, FOR A GREENSBORO DOWNTOWN PARKING PLAN 

    WHEREAS, on February 21, 2022, Procurement Services Division conducted an open solicitation through the Greensboro E-Procurement System for a Greensboro Downtown Parking Plan professional services contract;

    WHEREAS, the City of Greensboro, in cooperation the MPO, has determined to engage professional engineering and planning services to prepare a Downtown Greensboro Parking Plan in order to inform and guide City efforts to modernize parking policies, facilities, inventory, technology, and related consideration;  

    WHEREAS, the funding participation of NCDOT has been secured under the MPO’s adopted FY 2023 Unified Planning Work Program, and the necessary budget ordinances are in place; 

    WHEREAS, Kimley-Horn and Associates, Inc. was selected as the best qualified firm and the M/WBE office was involved in the process; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That the City Manager is authorized to enter into agreement with Kimley-Horn and Associates, Inc., for the Downtown Parking Plan.

    195-22 RESOLUTION APPROVING CONTRACT WITH HOUSING CONSULTANTS GROUP FOR HOMEBUYER EDUCATION, COUNSELING SERVICES AND ADMINISTRATIVE SERVICES IN THE AMOUNT OF $400,000

    WHEREAS, the City of Greensboro operates homeownership programs under Housing Connect GSO to link homebuyers and City partners through counseling, education, financial assistance and collaborations to ensure successful homeownership;

    WHEREAS, the City issued a request for proposals from HUD-certified agencies to provide homebuyer education, pre-counseling and financial literacy classes;

    WHEREAS, Housing Consultants Group is the vendor selected for a two year contract to provide the services;

    WHEREAS, Services will be provided at Housing Consultants Group, 1031 Summit Avenue, Greensboro, NC.  Referrals will be made to the City’s homebuyer assistance program for closing assistance and financial education classes; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO;

    City Council approves the award of $400,000 to Housing Consultants Group to provide Homebuyer Education, Housing Counseling and Administrative services to the Housing Connect GSO Program and authorizes the City Manager to sign contract documents.

    196-22 RESOLUTION AUTHORIZING AN AWARD OF $450,000 TO THE SERVANT CENTER FOR AN AFFORDABLE SUPPORTIVE HOUSING DEVELOPMENT PROJECT

    WHEREAS, federal American Rescue Plan program funds were included in a competitive Request for Proposals issued in October 2021;

    WHEREAS, funding from the American Rescue Plan will provide revenues for authorized government activities under the revenue loss category. This will provide grant availability in other revenues to allow for expenditures for $450,000;

    That it authorizes a financing commitment of up to $450,000 in City general funds for The Servant Center for the Servant House Transformation project, subject to the project meeting all financing conditions, and authorizes the City Manager to execute grant documents for this affordable supportive housing development project in conformity with the applicable federal and City regulations associated with the source of funding.

    197-22 RESOLUTION AUTHORIZING A COMMITMENT OF FUNDS IN THE AMOUNT OF $60,000 FOR JUNETEETH GREENSBORO FESTIVAL SUPPORT

    WHEREAS, City Council provided direction to establish funding for funding support to the Royal Expressions Ballet to execute the Juneteenth Greensboro Festival;

    WHEREAS, The Juneteenth Greensboro Festival is a city-wide celebration to commemorate Juneteenth, a holiday that reflects on the emancipation of slaves in Galveston, TX who received word that they were free almost two and a half years after the Emancipation Proclamation. This festival will celebrate Black culture through performances and community gatherings that are strategically accessible to the entire Greensboro community;

    WHEREAS, American Rescue Plan Act funding in the amount of $59.4 million was awarded to Greensboro with the first allocation of $29.7 million received by the City on May 19, 2021 and the remaining federal funds to be received by the end of May 2022;

    WHEREAS, the grantor, U. S. Treasury, has provided guidance on the use of funds, including for purposes of recovering revenue losses and grant funds can be used for authorized government services under this category;

    WHEREAS, funding from the American Rescue Plan will provide revenues for authorized government activities under the revenue loss category. This will provide grant availability in other revenues to allow for expenditures of $60,000;

    WHEREAS, Staff will administer the recording of these general government expenses using these funds in accordance with the guidance provided by U. S. Treasury and the use of grant revenues will make available general and other fund revenues to support projects identified through the American Rescue Plan process by City Council; and

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:

    That it authorizes a financing commitment of $60,000 in funds, $15,000 annually, for the Juneteenth Festival over 4 years, and authorizes the City Manager to execute the steps necessary to provide yearly funding support with the applicable federal and City regulations associated with the source of funding.

Councilmember Holston spoke to the Emergency Rental Assistance Program (ERAP); and to the War Memorial Commission events.

Mayor Vaughan extended condolences to Assistant City Manager Trey Davis' family; spoke to revised budget priorities; to a peer city compensation salary study; and to an upcoming work session.

City Manager Taiwo Jaiyeoba addressed the timeline for opening recreation center pools; highlighted the interactive online budget simulator calculator; and spoke to an upcoming work session.
